1 | AN ACT concerning regulation.
| ||||||||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||
3 | represented in the General Assembly:
| ||||||||||||||||||||||||
4 | Section 5. The Massage Licensing Act is amended by changing | ||||||||||||||||||||||||
5 | Section 25 as follows:
| ||||||||||||||||||||||||
6 | (225 ILCS 57/25)

7 | (Section scheduled to be repealed on January 1, 2022)
| ||||||||||||||||||||||||
8 | Sec. 25. Exemptions.
| ||||||||||||||||||||||||
9 | (a) This Act does not prohibit a person licensed
under any | ||||||||||||||||||||||||
10 | other Act
in this State
from
engaging in the practice for which | ||||||||||||||||||||||||
11 | he or she is licensed.
| ||||||||||||||||||||||||
12 | (b) Persons exempted under this Section include, but are | ||||||||||||||||||||||||
13 | not limited to,
physicians,
podiatric physicians, naprapaths, | ||||||||||||||||||||||||
14 | and physical therapists.
| ||||||||||||||||||||||||
15 | (c) Nothing in this Act prohibits qualified members of | ||||||||||||||||||||||||
16 | other
professional groups,
including but not limited to nurses, | ||||||||||||||||||||||||
17 | occupational therapists,
cosmetologists, and
estheticians, | ||||||||||||||||||||||||
18 | from performing massage in a manner consistent with their
| ||||||||||||||||||||||||
19 | training and the
code of ethics of their respective | ||||||||||||||||||||||||
20 | professions.
| ||||||||||||||||||||||||
21 | (d) Nothing in this Act prohibits a student of an approved | ||||||||||||||||||||||||
22 | massage
school or
program from performing massage, provided | ||||||||||||||||||||||||
23 | that the student does not hold
himself or herself out
as a |
| |||||||
| |||||||
1 | licensed massage therapist and does not receive compensation, | ||||||
2 | including tips, for massage therapy
services.
| ||||||
3 | (e) Nothing in this Act prohibits practitioners that do not | ||||||
4 | involve
intentional soft tissue manipulation, including but | ||||||
5 | not limited to Alexander
Technique, Feldenkrais, Reike, and | ||||||
6 | Therapeutic Touch, from practicing.
| ||||||
7 | (f) Practitioners of certain service marked bodywork | ||||||
8 | approaches that do
involve intentional soft tissue | ||||||
9 | manipulation, including but not limited to
Rolfing, Trager | ||||||
10 | Approach, Polarity Therapy, and Orthobionomy, are exempt from
| ||||||
11 | this Act if they are approved by their governing body based on | ||||||
12 | a minimum level
of training, demonstration of competency, and | ||||||
13 | adherence to ethical standards.
| ||||||
14 | (g) Until January 1, 2020, practitioners Practitioners of | ||||||
15 | Asian bodywork approaches are exempt from this Act if
they are | ||||||
16 | members of the American Organization of Bodywork Therapies of | ||||||
17 | Asia as
certified practitioners or if they are approved by an | ||||||
18 | Asian bodywork
organization based on a minimum level of | ||||||
19 | training, demonstration of competency,
and adherence to | ||||||
20 | ethical standards set by their governing body.
| ||||||
21 | (h) Practitioners of other forms of bodywork who restrict | ||||||
22 | manipulation of
soft tissue to the feet, hands, and ears, and | ||||||
23 | who do not have the client
disrobe, such as reflexology, are | ||||||
24 | exempt from this Act.
| ||||||
25 | (i) Nothing in this Act applies to massage therapists from | ||||||
26 | other states or
countries when providing educational programs |

| |||||||
1 | or services for a period not
exceeding 30 days within a | ||||||
2 | calendar year.
| ||||||
3 | (j) Nothing in this Act prohibits a person from treating | ||||||
4 | ailments by
spiritual means through prayer alone in accordance | ||||||
5 | with the tenets and
practices of a recognized church or | ||||||
6 | religious denomination.
| ||||||
7 | (k) Nothing in this Act applies to the practice of massage | ||||||
8 | therapy by a person either actively licensed as a massage | ||||||
9 | therapist in another state or currently certified by the | ||||||
10 | National Certification Board of Therapeutic Massage and | ||||||
11 | Bodywork or other national certifying body if said person's | ||||||
12 | state does not license massage therapists, if he or she is | ||||||
13 | performing his or her duties for a non-Illinois based team or | ||||||
14 | organization, or for a national athletic event held in this | ||||||
15 | State, so long as he or she restricts his or her practice to | ||||||
16 | his or her team or organization or to event participants during | ||||||
17 | the course of his or her team's or organization's stay in this | ||||||
18 | State or for the duration of the event. | ||||||

20 | Section 99. Effective date. This Act takes effect upon | ||||||
21 | becoming law.
