Bill Title: Amends the Illinois Power Agency Act. Provides that beginning April 1, 2012, and each year thereafter, the Illinois Power Agency shall prepare a report for the General Assembly and Illinois Commerce Commission that shall include, but not be limited to, renewable portfolio standards. Provides that a required annual report shall include the quantity, price, and rate impact of all renewable resources purchased pursuant to long-term contracts under the electricity procurement plans for electric utilities. Amends the Public Utilities Act. Provides that beginning April 1, 2012 and by April 1 of each year thereafter, the Illinois Power Agency shall submit an annual report to the General Assembly, the Commission, and alternative retail electric suppliers that shall include specified information. Effective immediately.

2 | AMENDMENT NO. ______. Amend Senate Bill 1609 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The Urban Weatherization Initiative Act is | ||||||
5 | amended by changing Section 40-40 as follows:

6 | (30 ILCS 738/40-40)

7 | Sec. 40-40. Weatherization Initiative Board.
| ||||||
8 | (a) The Weatherization Initiative Board is created within | ||||||
9 | the Department. The Board must approve or deny all grants from | ||||||
10 | the Fund. | ||||||
11 | (a-5) Notwithstanding any other provision of this Article, | ||||||
12 | the Board has the authority to direct the Department to | ||||||
13 | authorize the awarding of grants to applicants serving areas or | ||||||
14 | populations not included in the target areas and populations | ||||||
15 | set forth in Section 40-25 if the Board determines that there | ||||||
16 | are special circumstances involving the areas or populations |

1 | served by the applicant. | ||||||
2 | (b) The Board shall consist of 5 voting members appointed | ||||||
3 | by the Governor with the advice and consent of the Senate. The | ||||||
4 | initial members shall have terms as follows as designated by | ||||||
5 | the Governor: one for one year, one for 2 years, one for 3 | ||||||
6 | years, one for 4 years, and one for 5 years, or until a | ||||||
7 | successor is appointed and qualified. Thereafter, members | ||||||
8 | shall serve 5-year terms or until a successor is appointed and | ||||||
9 | qualified. The voting members shall elect a voting member to | ||||||
10 | serve as chair for a one-year term. Vacancies shall be filled | ||||||
11 | in the same manner for the balance of a term.

12 | (c) The Board shall also have 12 4 non-voting ex officio | ||||||
13 | members appointed as follows: 3 Representatives one | ||||||
14 | Representative appointed by the Speaker of the House, 3 | ||||||
15 | Representatives one Representative appointed by the House | ||||||
16 | Minority Leader, 3 Senators one Senator appointed by the | ||||||
17 | President of the Senate, and 3 Senators one Senator appointed | ||||||
18 | by the Senate Minority Leader, each to serve at the pleasure of | ||||||
19 | the appointing authority. | ||||||
20 | (d) Members shall receive no compensation, but may be | ||||||
21 | reimbursed for necessary expenses from appropriations to the | ||||||
22 | Department available for that purpose. | ||||||
23 | (e) The Board may adopt rules under the Illinois | ||||||
24 | Administrative Procedure Act. | ||||||
25 | (f) A quorum of the Board is at least 3 voting members, and | ||||||
26 | the affirmative vote of at least 3 voting members is required |

1 | for Board decisions and adoption of rules. | ||||||
2 | (g) The Department shall provide staff and administrative | ||||||
3 | assistance to the Board.

4 | (h) By December 31 of each year, the Board shall file an | ||||||
5 | annual report with the Governor and the General Assembly | ||||||
6 | concerning the Initiative, grants awarded, and grantees and | ||||||
7 | making recommendations for any changes needed to enhance the | ||||||
8 | effectiveness of the Initiative.

10 | Section 99. Effective date. This Act takes effect upon | ||||||
11 | becoming law.".
