Bill Title: Amends the Township Code. Provides that the corporate authorities of a township may, by ordinance, provide for the collection, transport, and disposal of brush and leaves within the unincorporated areas of the township (now, referendum approval is required). Provides that the corporate authorities of a township may, by ordinance, authorize the use of permanent road funds, general road and bridge funds, or town funds for the purpose of collecting, transporting, and disposing of brush and leaves generated from specified properties (now, referendum approval is required). Amends the Illinois Highway Code. Authorizes the highway commissioner of each road district to provide for the collection, transport, and disposal of brush and leaves that have been properly placed for collection along the road district rights-of-way in accordance with local guidelines in those townships or counties that regulate by ordinance open burning of brush or leaves.

1 AN ACT concerning local government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Township Code is amended by changing Section
530-117 and by adding Section 210-7 as follows:
6 (60 ILCS 1/30-117)
7 Sec. 30-117. Special services; disaster relief. The
8corporate authorities of a township electors may, by ordinance,
9authorize the use of permanent road funds, general road and
10bridge funds, or town funds for the purpose of collecting,
11transporting, and disposing of brush and leaves generated from
12those properties that are contiguous to roads as defined by
13Section 2-103 of the Illinois Highway Code or located within
14the unincorporated areas of the township.
15 The Further, the electors may allow general road and bridge
16or town funds to also be used for the purpose of providing
17disaster relief and support services approved by the Township
18Board of Trustees at a regularly scheduled or special meeting.

22 Sec. 210-7. Disposal of brush and leaves. Notwithstanding

1any provision of this Article to the contrary, the corporate
2authorities of a township may, by ordinance, provide for the
3collection, transport, and disposal of brush and leaves within
4the unincorporated areas of the township without referendum
5approval. The corporate authorities of the township may use
6funds authorized under Section 30-117 to provide for the
7collection, transport, and disposal of brush and leaves.
8 Section 10. The Illinois Highway Code is amended by
9changing Section 6-201.21 as follows:

11 Sec. 6-201.21. Special services; disaster relief. The
12Subject to Section 30-117 of the Township Code, the highway
13commissioner has authority to provide for orderly collection,
14transport, and disposal of brush and leaves that have been
15properly placed for collection along the road district
16rights-of-way in accordance with local guidelines in those
17townships or counties that regulate by ordinance open burning
18of brush or leaves. The highway commissioner may use funds
19authorized under Section 30-117 of the Township Code to provide
20for the collection, transport, and disposal of brush and
21leaves.
22 Subject to Section 30-117 of the Township Code Further, the
23highway commissioner has authority to provide necessary relief
24services following the occurrence of an event that has been

1declared a disaster by State or local officials. The highway
2commissioner has purchasing authority, subject to Section
36-201.6, and contractual authority as defined in Section
46-201.7 of this Code.
