Bill Title: Amends the Township Code. Provides that the corporate authorities of a township may, by ordinance, provide for the collection, transport, and disposal of brush and leaves within the unincorporated areas of the township (now, referendum approval is required). Provides that the corporate authorities of a township may, by ordinance, authorize the use of permanent road funds, general road and bridge funds, or town funds for the purpose of collecting, transporting, and disposing of brush and leaves generated from specified properties (now, referendum approval is required). Amends the Illinois Highway Code. Authorizes the highway commissioner of each road district to provide for the collection, transport, and disposal of brush and leaves that have been properly placed for collection along the road district rights-of-way in accordance with local guidelines in those townships or counties that regulate by ordinance open burning of brush or leaves.

2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Township Code is amended by changing Section | ||||||
5 | 30-117 and by adding Section 210-7 as follows:

7 | Sec. 30-117. Special services; disaster relief. The | ||||||
8 | corporate authorities of a township electors may , by ordinance, | ||||||
9 | authorize
the use
of permanent
road funds, general road and | ||||||
10 | bridge funds, or
town funds for the purpose of
collecting, | ||||||
11 | transporting, and disposing of brush and leaves generated from
| ||||||
12 | those
properties that are contiguous to roads as defined by | ||||||
13 | Section 2-103 of the Illinois Highway Code or located within | ||||||
14 | the unincorporated areas of the township . | ||||||
15 | The Further, the
electors may allow general road and bridge | ||||||
16 | or town funds to also be used for
the
purpose of providing | ||||||
17 | disaster relief and support services approved by
the Township | ||||||
18 | Board of Trustees at a regularly scheduled or special meeting.

1 | any provision of this Article to the contrary, the corporate | ||||||
2 | authorities of a township may, by ordinance, provide for the | ||||||
3 | collection, transport, and disposal of brush and leaves within | ||||||
4 | the unincorporated areas of the township without referendum | ||||||
5 | approval. The corporate authorities of the township may use | ||||||
6 | funds authorized under Section 30-117 to provide for the | ||||||
7 | collection, transport, and disposal of brush and leaves.

8 | Section 10. The Illinois Highway Code is amended by | ||||||
9 | changing Section 6-201.21 as follows:

12 | Subject to Section
30-117 of the Township Code, the highway | ||||||
13 | commissioner has authority to provide
for orderly collection , | ||||||
14 | transport, and disposal of brush and leaves that have been | ||||||
15 | properly
placed for collection along the road district | ||||||
16 | rights-of-way in accordance with
local guidelines in those | ||||||
17 | townships or counties that regulate by ordinance open
burning | ||||||
18 | of brush or leaves . The highway commissioner may use funds | ||||||
19 | authorized under Section 30-117 of the Township Code to provide | ||||||
20 | for the collection, transport, and disposal of brush and | ||||||
21 | leaves. | ||||||
22 | Subject to Section 30-117 of the Township Code Further , the | ||||||
23 | highway commissioner has authority to
provide necessary relief | ||||||
24 | services following the occurrence of an event that has

1 | declared a disaster by State or local officials. The highway | ||||||
2 | commissioner
has purchasing authority, subject to Section | ||||||
3 | 6-201.6, and contractual authority
as defined in

4 | 6-201.7 of this Code.
