2 | AMENDMENT NO. ______. Amend House Bill 4983 by replacing | ||||||
3 | everything after the enacting clause with the following:
| ||||||
4 | "Section 5. The Township Code is amended by changing | ||||||
5 | Section 70-15 as follows:
| ||||||
6 | (60 ILCS 1/70-15)
| ||||||
7 | Sec. 70-15. Chief executive officer; fiscal duties; | ||||||
8 | penalty for neglect.
| ||||||
9 | (a) The supervisor is the chief executive officer of the | ||||||
10 | township.
| ||||||
11 | (b) The supervisor shall receive and pay out all moneys | ||||||
12 | raised in the
township for defraying township charges, except | ||||||
13 | those raised for the support of
highways and bridges, and for | ||||||
14 | township library purposes.
| ||||||
15 | In addition, the township board of trustees may designate a | ||||||
16 | co-signer for the payout of all township moneys. Only an |
| |||||||
| |||||||
1 | elected township official may serve as a co-signer. Before an | ||||||
2 | elected township official may perform the duties of a | ||||||
3 | co-signer, he or she shall give bond to the township with one | ||||||
4 | or more sureties: (i) in at least twice the amount of money | ||||||
5 | that may come into the supervisor's hands, if individuals act | ||||||
6 | as sureties, or (ii) only in the amount of money that may come | ||||||
7 | into the supervisor's hands if a surety company authorized to | ||||||
8 | do business in this State acts as surety. The bond shall be | ||||||
9 | conditioned on the faithful discharge of his or her duties as | ||||||
10 | co-signer, approved by the supervisor, and filed with the | ||||||
11 | township clerk. If the township board of trustees determines | ||||||
12 | that the bond has been forfeited, the co-signer shall no longer | ||||||
13 | have the authority granted to him or her under this Section. A | ||||||
14 | co-signer's signature is not required for emergency assistance | ||||||
15 | funds received under Section 6-10 of the Illinois Public Aid | ||||||
16 | Code if the grant does not exceed the maximum amount for an | ||||||
17 | individual recipient. | ||||||
18 | (c) The supervisor shall, within 30 days before the annual | ||||||
19 | township
meeting, prepare and file with the township clerk a | ||||||
20 | full statement
of the financial affairs of the township, | ||||||
21 | showing (i) the balance (if any)
received by the supervisor | ||||||
22 | from his or her predecessor in office or from any
other source; | ||||||
23 | (ii) the amount of tax levied the preceding year for the | ||||||
24 | payment
of township indebtedness and charges; (iii) the amount | ||||||
25 | collected and paid over
to the supervisor as supervisor; (iv) | ||||||
26 | the amount paid out by the supervisor and
on what account, |

1 | including any amount paid out on township indebtedness,
| ||||||
2 | specifying the nature and amount of the township indebtedness, | ||||||
3 | the amount paid
on the indebtedness, the amount paid on | ||||||
4 | principal, and the amount paid on
interest account; and (v) the | ||||||
5 | amount and kind of all outstanding indebtedness
due and unpaid, | ||||||
6 | the amount and kind of indebtedness not yet due, and when the
| ||||||
7 | indebtedness not yet due will mature. The township clerk shall | ||||||
8 | record the
statement in the record book of the township as soon | ||||||
9 | as it is filed and
shall post
a copy of the statement at the | ||||||
10 | place of holding the annual township meeting 2
days before the | ||||||
11 | meeting is held. The clerk shall also read aloud the statement
| ||||||
12 | to the electors at the annual township meeting.
| ||||||
13 | (d) Any supervisor or township clerk who wilfully neglects | ||||||
14 | to comply with
this Section shall forfeit and pay to the | ||||||
15 | township the sum of not less than $50
nor more than $200. The | ||||||
16 | amount forfeited shall be sued for and recovered by the
| ||||||
17 | township in its corporate name and shall be appropriated to | ||||||
18 | repairs of highways
and bridges in the township.

20 | Section 10. The Illinois Highway Code is amended by | ||||||
21 | changing Section 6-205 as follows:

22 | (605 ILCS 5/6-205) (from Ch. 121, par. 6-205)
| ||||||
23 | Sec. 6-205. The district treasurer shall receive and have | ||||||
24 | charge of
all moneys raised in the district for the support and |

| |||||||
1 | maintenance of
roads therein, and for road damages except such | ||||||
2 | portions of the moneys
which by Section 6-507 are directed to | ||||||
3 | be paid to the municipalities.
He or she shall hold such moneys | ||||||
4 | at all times subject to the order of the
highway commissioner | ||||||
5 | and shall pay them over upon the order of the
commissioner, | ||||||
6 | such order to be countersigned by the town or district
clerk. | ||||||
7 | In counties under township organization such moneys, other than | ||||||
8 | Social
Security taxes required by the Social Security Enabling | ||||||
9 | Act, shall not be
paid over until the board of town trustees or | ||||||
10 | highway board of auditors,
as the case may be, has examined and | ||||||
11 | audited the claims or charges for
which such order is drawn. He | ||||||
12 | or she shall keep an account in a book provided by the
| ||||||
13 | commissioner of all moneys received, and all moneys paid out, | ||||||
14 | showing in
detail to whom and on what account the same is so | ||||||
15 | paid.

16 | The township board of trustees or the highway board of | ||||||

19 | official may serve as a co-signer. Before an elected township | ||||||

23 | that may come into the road district treasurer's hands, if | ||||||
24 | individuals act as sureties, or (ii) only in the amount of | ||||||
25 | money that may come into the road district treasurer's hands if | ||||||
26 | a surety company authorized to do business in this State acts |

8 | The treasurer shall also present annually, within 30 days | ||||||
9 | after the
end of the fiscal year of the district, to the | ||||||
10 | highway commissioner an
itemized statement of receipts and | ||||||
11 | disbursements of the district during
the fiscal year just | ||||||
12 | ended, which shall be sworn to.

14 | Section 99. Effective date. This Act takes effect January | ||||||
