AN ACT concerning safety.
| ||||
Be it enacted by the People of the State of Illinois,
| ||||
represented in the General Assembly:
| ||||
Section 5. The Hazardous Materials Emergency Act is amended | ||||
by changing Sections 5.03 and 5.07 as follows:
| ||||
(430 ILCS 50/5.03) (from Ch. 127, par. 1255.03)
| ||||
Sec. 5.03.
To establish a program , with the advice and | ||||
recommendations of the
Board, for utilization of the State's | ||||
communication systems (a) to accept telephone
reports of | ||||
accidents involving hazardous materials; (b) to relate to the | ||||
emergency
agencies in the vicinity of the accident any | ||||
information available about
the location and
type of accident, | ||||
nature of the hazardous material involved, and any precautions
| ||||
which should be taken in handling the material; and (c) to | ||||
report to and
coordinate with the other
State agencies or | ||||
departments which might be knowledgeable about the type of | ||||
accident
or the hazardous material involved and with the United | ||||
States Department
of Transportation.

All files, records and data gathered by the Agency or the | ||||
Department
under this Act shall be made available to the | ||||
Department of Public Health
pursuant to the Illinois Health and | ||||
Hazardous Substances Registry
Act.

Sec. 5.07.
To coordinate with the other members of the | ||
Board to determine
which department or agency can best, within | ||
the statutory scope of its duties,
inspect
facilities and | ||
equipment for the use, storage, transportation, and | ||
manufacture
of hazardous materials to determine whether they | ||
are in compliance
with applicable federal or State regulations.

Section 10. The Hazardous Materials Emergency Act is | ||
amended by repealing Sections 2.04 and 4.
