Bill Title: Amends the Illinois Municipal Code and the Fire Protection District Act. Provides that a person applying for a position in a fire department or fire protection district must disclose if he or she has been convicted, arrested, or charged with arson, aggravated arson, or criminal damage to property due to recklessly, by means of fire, damaging the property of another or knowingly starting a fire on the land of another. Provides that the person or board hiring an individual who has applied to a position in a fire department or fire protection district may take into consideration the disclosed convictions, arrests, or charges in the hiring or retention of the applicant. Effective immediately.

1 | AN ACT concerning local government.

2 | Be it enacted by the People of the State of Illinois,

3 | represented in the General Assembly:

4 | Section 5. The Illinois Municipal Code is amended by | |||||||||||||||||||||
5 | adding Section 11-6-12 as follows:

7 | Sec. 11-6-12. Disclosure of offenses. | |||||||||||||||||||||
8 | (a) Notwithstanding any other provisions of law, a person | |||||||||||||||||||||
9 | applying for a position in a fire department must disclose if | |||||||||||||||||||||
10 | he or she has been convicted, arrested, or charged with arson, | |||||||||||||||||||||
11 | aggravated arson, or criminal damage to property due to | |||||||||||||||||||||
12 | recklessly, by means of fire, damaging the property of another | |||||||||||||||||||||
13 | or knowingly starting a fire on the land of another. | |||||||||||||||||||||
14 | (b) The person or board hiring an individual who has | |||||||||||||||||||||
15 | applied to a position in a fire department may take into | |||||||||||||||||||||
16 | consideration the item or items disclosed under subsection (a) | |||||||||||||||||||||
17 | in the hiring or retention of the applicant.

18 | Section 10. The Fire Protection District Act is amended by | |||||||||||||||||||||
19 | adding Section 16.06d as follows:

12 | becoming law.
