1 | AN ACT concerning State government.
| |||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||
4 | Section 5. The Department of Public Health Act is amended | |||||||||||||||||||
5 | by changing Section 8.1 as follows:

7 | Sec. 8.1.
Whoever violates or refuses to obey any rule or
| |||||||||||||||||||
8 | regulation of the
the
Department of Public Health shall be | |||||||||||||||||||
9 | deemed guilty of a Class A
misdemeanor. The Director of Public | |||||||||||||||||||
10 | Health shall institute prosecutions and
proceedings for | |||||||||||||||||||
11 | violation of the rules and regulations adopted by the
| |||||||||||||||||||
12 | Department of Public Health, provided that he may designate a | |||||||||||||||||||
13 | local board
of health or local health officer to institute | |||||||||||||||||||
14 | prosecutions or proceedings
for violation of those rules and | |||||||||||||||||||
15 | regulations adopted by the Department.
Each State's Attorney | |||||||||||||||||||
16 | shall prosecute all persons in his county violating
or refusing | |||||||||||||||||||
17 | to obey the rules and regulations of the Department of Public
| |||||||||||||||||||
18 | Health. All fines or judgments collected or received shall be | |||||||||||||||||||
19 | paid to the
County Treasurer of the county in which prosecution | |||||||||||||||||||
20 | is conducted. | |||||||||||||||||||
