Bill Title: Amends the Illinois Vehicle Code. Provides that no person may occupy a vehicle or the cargo area of a second division vehicle while it is being towed upon a public highway. Creates an exemption when the vehicle does not exceed 15 miles per hour and is used in connection with a parade or farming activity, or if the speed does not exceed 15 miles per hour and the passenger is over 18.

1 AN ACT concerning transportation.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Illinois Vehicle Code is amended by changing
5Section 11-1408 as follows:
6 (625 ILCS 5/11-1408) (from Ch. 95 1/2, par. 11-1408)
7 Sec. 11-1408. Riding in certain vehicles, riding in certain
8cargo areas of second division vehicles house trailers.
9 (a) No person or persons shall occupy a house trailer,
10semitrailer, farm wagon, or any other vehicle travel trailer
11while it is being towed upon a public highway, unless the
12occupancy of the towed vehicle is necessary to avoid an
13imminent threat to a person's safety due to extreme weather
14conditions or another emergency situation.
15 (b) No person or persons may occupy the cargo area of a
16second division vehicle while it is being operated upon a
17public highway, unless (i) the speed of the vehicle does not
18exceed 15 miles per hour and is used in connection with a
19parade, farming related activity, or similar activity; or (ii)
20the speed of the vehicle does not exceed 15 miles per hour and
21the passenger is over the age of 18.
