Bill Title: Amends the Illinois Vehicle Code. Provides that no person may occupy a vehicle or the cargo area of a second division vehicle while it is being towed upon a public highway. Creates an exemption when the vehicle does not exceed 15 miles per hour and is used in connection with a parade or farming activity, or if the speed does not exceed 15 miles per hour and the passenger is over 18.

AN ACT concerning transportation.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Illinois Vehicle Code is amended by changing
Section 11-1408 as follows:
(625 ILCS 5/11-1408) (from Ch. 95 1/2, par. 11-1408)
Sec. 11-1408. Riding in certain vehicles, riding in certain
cargo areas of second division vehicles house trailers.
(a) No person or persons shall occupy a house trailer,
semitrailer, farm wagon, or any other vehicle travel trailer
while it is being towed upon a public highway, unless the
occupancy of the towed vehicle is necessary to avoid an
imminent threat to a person's safety due to extreme weather
conditions or another emergency situation.
(b) No person or persons may occupy the cargo area of a
second division vehicle while it is being operated upon a
public highway, unless (i) the speed of the vehicle does not
exceed 15 miles per hour and is used in connection with a
parade, farming related activity, or similar activity; or (ii)
the speed of the vehicle does not exceed 15 miles per hour and
the passenger is over the age of 18.
