Bill Title: Amends the Humane Care for Animals Act. Prohibits a person from transporting, or causing or allowing to be transported, any equine animal in or upon a trailer, conveyance, or any other vehicle with 2 or more levels stacked upon one another. Creates penalties for violations. Effective immediately.

1 AN ACT concerning animals.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Humane Care for Animals Act is amended by
5 adding Section 7.2 as follows:
6 (510 ILCS 70/7.2 new)
7 Sec. 7.2. Transport Prohibitions for Equines.
8 (a) Notwithstanding any other provision of law, a person
9 may not transport, or cause or allow to be transported, any
10 equine animal in or upon any trailer, conveyance, or other
11 vehicle whatsoever with 2 or more levels stacked on top of one
12 another.
13 (b) A person convicted of violating this Section or any
14 rule, regulation, or order of the Department pursuant thereto
15 is guilty of a Class B misdemeanor for each equine animal
16 transported. A second or subsequent violation is a Class 4
17 felony, with every day that a violation continues constituting
18 a separate offense.
19 Section 99. Effective date. This Act takes effect upon
20 becoming law.
