2 | AMENDMENT NO. ______. Amend House Bill 5620 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The Illinois Vehicle Code is amended by | ||||||
5 | changing Section 11-1404 as follows:
| ||||||
6 | (625 ILCS 5/11-1404) (from Ch. 95 1/2, par. 11-1404) | ||||||
7 | Sec. 11-1404. Special equipment for persons riding | ||||||
8 | motorcycles, motor driven cycles , or mopeds. | ||||||
9 | (a) The operator of a motorcycle, motor driven cycle , or | ||||||
10 | moped and every passenger thereon shall be protected by | ||||||
11 | glasses, goggles , or a transparent shield. | ||||||
12 | (a-5) In addition to the requirements of subsection (a), | ||||||
13 | an operator or passenger of a motorcycle, motor driven cycle, | ||||||
14 | or moped who is less than 18 years of age shall be protected by | ||||||
15 | a motorcycle helmet. | ||||||
16 | (b) For the purposes of this Section, glasses, goggles, |

1 | motorcycle helmet, and transparent shields are defined as | ||||||
2 | follows: | ||||||
3 | "Glasses" means ordinary eye pieces such as spectacles or | ||||||
4 | sunglasses worn before the eye, made of shatter-resistant | ||||||
5 | material. " Shatter-resistant material " , as used in this | ||||||
6 | Section, means material so manufactured, fabricated, or | ||||||
7 | created that it substantially prevents shattering or flying | ||||||
8 | when struck or broken. | ||||||
9 | "Goggles" means a device worn before the eyes, the | ||||||
10 | predominant function of which is protecting the eyes without | ||||||
11 | obstructing peripheral vision. Goggles shall provide | ||||||
12 | protection from the front and sides, and may or may not form a | ||||||
13 | complete seal with the face. | ||||||
14 | "Motorcycle helmet" means a protective covering for the | ||||||
15 | head consisting of a hard outer shell, padding adjacent to and | ||||||
16 | inside the outer shell and a chin-strap type retention system | ||||||
17 | with a sticker indicating that the motorcycle helmet meets | ||||||
18 | standards established by the United States Department of | ||||||
19 | Transportation. | ||||||
20 | "Transparent shield" means a windshield attached to the | ||||||
21 | front of a motorcycle that extends above the eyes when an | ||||||
22 | operator is seated in the normal, upright riding position, | ||||||
23 | made of shatter-resistant material, or a shatter-resistant | ||||||
24 | protective face shield that covers the wearer's eyes and face | ||||||
25 | at least to a point approximately to the tip of the nose. | ||||||
26 | (c) Contact lenses are not acceptable eye protection |
