Moneys allocated under this 21 lettered paragraph may be used by the early childhood Iowa 22 state board for the purpose of skills development and support 23 for ongoing training of staff. However, except as otherwise 24 provided in this subsection, moneys shall not be used for 25 additional staff or for the reimbursement of staff. 26 b. Of the amount appropriated in this subsection for 27 deposit in the school ready children grants account of the 28 early childhood Iowa fund, $1,159,009 $2,318,018 shall 29 be used for efforts to improve the quality of early care, 30 health, and education programs. Moneys allocated pursuant to 31 this paragraph may be used for additional staff and for the 32 reimbursement of staff. The early childhood Iowa state board 33 may reserve a portion of the allocation, not to exceed $44,325 34 $88,650 , for the technical assistance expenses of the early 35 -7- LSB 5013JB (3) 86 kh/tm 7/ 38
S.F. _____ H.F. _____ childhood Iowa state office, including the reimbursement of 1 staff, and shall distribute the remainder to early childhood 2 Iowa areas for local quality improvement efforts through a 3 methodology identified by the early childhood Iowa state board 4 to make the most productive use of the funding, which may 5 include use of the distribution formula, grants, or other 6 means. 7 c. Of the amount appropriated in this subsection for 8 deposit in the school ready children grants account of the 9 early childhood Iowa fund, $412,515 $825,030 shall be used for 10 support of professional development and training activities 11 for persons working in early care, health, and education by 12 the early childhood Iowa state board in collaboration with 13 the professional development component groups maintained by 14 the early childhood Iowa stakeholders alliance pursuant to 15 section 256I.12, subsection 7 , paragraph “b”, and the early 16 childhood Iowa area boards. Expenditures shall be limited to 17 professional development and training activities agreed upon by 18 the parties participating in the collaboration. 19 10. The moneys appropriated in this subsection shall be 14 used for implementation and expansion of early head start 15 pilot projects addressing the comprehensive cognitive, social, 16 emotional, and developmental needs of children from birth to 17 age three, including prenatal support for qualified families. 18 The projects shall promote healthy prenatal outcomes and 19 healthy family functioning, and strengthen the development of 20 infants and toddlers in low-income families. Priority shall be 21 given to those organizations that have previously qualified for 22 and received state funding to administer an early head start 23 project. 24 14. TEXTBOOKS OF NONPUBLIC SCHOOL PUPILS 25 a. NEW SECTION . 256.34 Fine arts beginning teacher 17 mentoring program. 18 1. The department shall establish a fine arts beginning 19 teacher mentoring program under a contract with an Iowa-based 20 nonprofit organization that is exempt from federal income 21 taxation pursuant to section 501(c)(3) of the Internal Revenue 22 Code; has membership from the six state fine arts organizations 23 representing kindergarten through grade twelve general music, 24 choral music, instrumental music, visual arts, and drama and 25 theater arts educators; and has administered a federally funded 26 statewide fine arts mentoring program since 2006. 27 2. Program criteria shall include a required match of one 28 dollar provided by the organization contracting to deliver 29 services under subsection 1 for each dollar provided to the 30 organization by the department. Moneys in the fund established 31 under subsection 6 shall not be disbursed until the department 32 receives evidence that the organization meets or will meet the 33 match requirement. 34 3. The program provided under contract by the nonprofit 35 -23- LSB 5013JB (3) 86 kh/tm 23/ 38
S.F. _____ H.F. _____ organization shall provide for all of the following: 1 a. Activities and consultation in support of beginning fine 2 arts teachers employed in Iowa’s school districts, including 3 but not limited to guidance in the classroom and at meetings, 4 and resources of materials, time, and financial scholarship 5 for state conferences that will support a beginning fine arts 6 teacher’s effectiveness in the classroom. 7 b. Coordination of retired and currently employed 8 experienced fine arts mentor educators with beginning fine arts 9 educators. 10 c. Materials and advice specifically designed to prepare 11 beginning fine arts teachers for success in the fine arts 12 classroom and to prepare kindergarten through grade twelve 13 students for school district fine arts performances and 14 festivals. 15 4. The nonprofit organization under contract with the 16 department under this section shall provide quarterly reports 17 detailing the organization’s compliance with the requirements 18 of subsection 3 and the expenditures of moneys for purposes of 19 the fine arts beginning teacher mentoring program. 20 5. The director of the department may for good cause 21 suspend, revoke, or refuse to renew a contract entered into in 22 accordance with the provisions of this section. 23 6. There is established in the state treasury a fine arts 24 beginning teacher mentoring fund that is under the control 25 of and administered by the department of education. The 26 department may accept gifts, grants, bequests, and other 27 private contributions, as well as state or federal funds, and 28 shall deposit the moneys in the fund to be used for purposes of 29 the fine arts beginning teacher mentoring program. Moneys in 30 the fund are appropriated to the department and shall be used 31 for the purposes of this section. Moneys in the fund may be 32 used to reimburse mentors for business travel expenses incurred 33 in the performance of a mentor’s duties at a rate not to exceed 34 the current rate of reimbursement allowed under the standard 35 -24- LSB 5013JB (3) 86 kh/tm 24/ 38
S.F. _____ H.F. _____ method for computation of business travel expenses pursuant to 1 the Internal Revenue Code. The department shall not commingle 2 federal, state, and private funds within the fund. Moneys 3 appropriated for the program shall supplement, not supplant, 4 moneys appropriated for purposes of the beginning teacher 5 mentoring and induction program created under section 284.5. 6 Notwithstanding section 8.33, moneys in the fund that remain 7 unencumbered or unobligated at the close of the fiscal year 8 shall not revert but shall remain available for expenditure 9 for the purposes designated until the close of the succeeding 10 fiscal year. Notwithstanding section 12C.7, subsection 2, 11 interest earned on moneys in the fine arts beginning teacher 12 mentoring fund shall be credited to the fund. 13 Sec. 7. Section 256C.4, subsection 1, paragraph e, Code 14 2016, is amended to read as follows: 15 e. Preschool foundation aid funding shall not be used for 16 the costs of constructing a facility in connection with an 17 approved local program. Preschool foundation aid funding may 18 be used by approved local programs and community providers 19 for professional development for preschool teachers, for 20 instructional equipment, for material and equipment designed 21 to develop pupils’ large and small motor skills, and for other 22 direct costs. Preschool foundation aid funding may be used 23 by approved local programs for the costs of transportation 24 involving children participating in the preschool program. 25 The costs of transporting other children associated with the 26 preschool program or transported as provided in section 256C.3, 27 subsection 3, paragraph “h” , may be prorated by the school 28 district. Preschool foundation aid funding received by an 29 approved local program that remain unexpended or unobligated 30 at the end of a fiscal year shall be used to build the approved 31 local program’s preschool program capacity in the next 32 succeeding fiscal year. 33 Sec. 8. Section 261.25, subsection 2, Code 2016, is amended 34 to read as follows: 35 -25- LSB 5013JB (3) 86 kh/tm 25/ 38

There is appropriated from the general fund of the 1 state to the commission for each fiscal year the sum of two 2 million dollars for tuition grants for students attending 3 for-profit accredited private institutions located in Iowa. 4 A for-profit institution which, effective March 9, 2005, or 5 effective January 8, 2010, purchased an accredited private 6 institution that was exempt from taxation under section 501(c) 7 of the Internal Revenue Code, shall be an eligible institution 8 under the tuition grant program. For purposes of the tuition 9 grant program, “for-profit accredited private institution” 10 means an accredited private institution which is not exempt 11 from taxation under section 501(c)(3) of the Internal Revenue 12 Code but which otherwise meets the requirements of section 13 261.9, subsection 1 , paragraph “b” , and whose students were 14 eligible to receive tuition grants in the fiscal year beginning 15 July 1, 2003 ; or a barber school licensed under section 158.7 16 or a school of cosmetology arts and sciences licensed under 17 chapter 157, each of which shall be accredited by a national 18 accrediting agency recognized by the United States department 19 of education . 20 Sec. 9. Section 261.86, subsection 6, Code 2016, is amended 21 to read as follows: 22 6. Notwithstanding section 8.33 , until one year after the 23 date the president of the United States or the Congress of 24 the United States declares a cessation of hostilities ending 25 operation Iraqi freedom, operation new dawn, and operation 26 enduring freedom, funds appropriated for purposes of this 27 section which remain unencumbered or unobligated at the close 28 of the fiscal year for which the funds were appropriated shall 29 not revert but shall be available for expenditure for the 30 following fiscal year for purposes of this section . 31 Sec. 10. Section 272.28, subsection 1, Code 2016, is amended 32 to read as follows: 33 1. Effective July 1, 2003, requirements Requirements for 34 teacher licensure beyond an initial license shall include 35 -26- LSB 5013JB (3) 86 kh/tm 26/ 38
S.F. _____ H.F. _____ successful completion of a beginning teacher mentoring and 1 induction program approved by the state board of education or 2 evidence of not less than three years of successful teaching 3 experience at any of the following: 4 a. An accredited nonpublic school in this state . 5 b. A preschool program approved by the United States 6 department of health and human services. 7 c. Preschool programs at school districts approved to 8 participate in the preschool program under chapter 256C. 9 d. Shared visions and other preschool programs provided 10 under the auspices of or receiving grants from the child 11 development coordinating council under section 256A.3. 12 e. Preschool programs receiving moneys from the school 13 ready children grants account of the early childhood Iowa fund 14 created in section 256I.11. 15 Sec. 11. Section 279.68, subsection 1, paragraph c, Code 16 2016, is amended to read as follows: 17 c. Beginning May 1, 2017 2018 , unless the school district 18 is granted a waiver pursuant to subsection 2 , paragraph “e” , 19 if the student’s reading deficiency is not remedied by the 20 end of grade three, as demonstrated by scoring on a locally 21 determined or statewide assessment as provided in section 22 256.7, subsection 31 , the school district shall notify the 23 student’s parent or guardian that the parent or guardian may 24 enroll the student in an intensive summer reading program 25 offered in accordance with subsection 2 , paragraph “e” . If 26 the parent or guardian does not enroll the student in the 27 intensive summer reading program and the student is ineligible 28 for the good cause exemption under subsection 5 , the student 29 shall be retained in grade three pursuant to subsection 3 . 30 If the student is exempt from participating in an intensive 31 summer reading program for good cause, pursuant to subsection 32 5 , or completes the intensive summer reading program but is 33 not reading proficient upon completion of the program, the 34 student may be promoted to grade four, but the school district 35 -27- LSB 5013JB (3) 86 kh/tm 27/ 38
S.F. _____ H.F. _____ shall continue to provide the student with intensive reading 1 instruction until the student is proficient in reading as 2 demonstrated by scoring on locally determined or statewide 3 assessments. 4 Sec. 12. Section 279.68, subsection 2, paragraph e, Code 5 2016, is amended to read as follows: 6 e. Offer each summer, beginning in the summer of 2017 7 2018 , unless the school district receives a waiver from this 8 requirement from the department of education for the summer of 9 2017 2018 , an intensive summer literacy program for students 10 assessed as exhibiting a substantial deficiency in reading. 11 The program shall meet the criteria and follow the guidelines 12 established pursuant to section 256.9, subsection 53 , paragraph 13 “c” , subparagraph (1), subparagraph division (g). 14 Sec. 13. Section 284.13, subsection 1, paragraphs a, b, c, 15 and d, Code 2016, are amended to read as follows: 16 a. For the fiscal year beginning July 1, 2015 2016 , and 17 ending June 30, 2016 2017 , to the department of education, the 18 amount of eight hundred forty-six thousand two hundred fifty 19 dollars for the issuance of national board certification awards 20 in accordance with section 256.44 . Of the amount allocated 21 under this paragraph, not less than eighty-five thousand 22 dollars shall be used to administer the ambassador to education 23 position in accordance with section 256.45 . 24 b. For the fiscal year beginning July 1, 2015 2016 , and 25 ending June 30, 2016 2017 , an amount up to four million 26 twenty-one thousand eight hundred seventy-five dollars 27 for first-year and second-year beginning teachers, to the 28 department of education for distribution to school districts 29 and area education agencies for purposes of the beginning 30 teacher mentoring and induction programs. A school district or 31 area education agency shall receive one thousand three hundred 32 dollars per beginning teacher participating in the program. 33 If the funds appropriated for the program are insufficient to 34 pay mentors, school districts, and area education agencies 35 -28- LSB 5013JB (3) 86 kh/tm 28/ 38
S.F. _____ H.F. _____ as provided in this paragraph, the department shall prorate 1 the amount distributed to school districts and area education 2 agencies based upon the amount appropriated. Moneys received 3 by a school district or area education agency pursuant to 4 this paragraph shall be expended to provide each mentor with 5 an award of five hundred dollars per semester, at a minimum, 6 for participation in the school district’s or area education 7 agency’s beginning teacher mentoring and induction program; 8 to implement the plan; and to pay any applicable costs of the 9 employer’s share of contributions to federal social security 10 and the Iowa public employees’ retirement system or a pension 11 and annuity retirement system established under chapter 294 , 12 for such amounts paid by the district or area education agency. 13 c. For the fiscal year beginning July 1, 2015 2016 , and 14 ending June 30, 2016 2017 , up to seven hundred eighty-six 15 thousand eight hundred sixteen dollars to the department for 16 purposes of implementing the professional development program 17 requirements of section 284.6 , assistance in developing model 18 evidence for teacher quality committees established pursuant to 19 section 284.4, subsection 1 , paragraph “c” , and the evaluator 20 training program in section 284.10 . A portion of the funds 21 allocated to the department for purposes of this paragraph may 22 be used by the department for administrative purposes and for 23 not more than four full-time equivalent positions. 24 d. For the fiscal year beginning July 1, 2015 2016 , and 25 ending June 30, 2016 2017 , an amount up to one million one 26 hundred thirty-six thousand four hundred ten dollars to 27 the department for the establishment of teacher development 28 academies in accordance with section 284.6, subsection 10 . A 29 portion of the funds allocated to the department for purposes 30 of this paragraph may be used for administrative purposes. 31 Sec. 14. Section 284.13, subsection 1, paragraph e, 32 subparagraph (1), subparagraph division (b), Code 2016, is 33 amended to read as follows: 34 (b) For the fiscal year beginning July 1, 2016, and ending 35 -29- LSB 5013JB (3) 86 kh/tm 29/ 38
S.F. _____ H.F. _____ June 30, 2017, fifty million six hundred thousand dollars. 1 Sec. 15. Section 284.13, subsection 1, paragraph f, Code 2 2016, is amended to read as follows: 3 f. For the fiscal year beginning July 1, 2016 2017 , 4 and for each subsequent fiscal year, to the department of 5 education, ten million dollars for purposes of implementing 6 the supplemental assistance for high-need schools provisions 7 of section 284.11 . Annually, of the moneys allocated to 8 the department for purposes of this paragraph, up to one 9 hundred thousand dollars may be used by the department for 10 administrative purposes and for not more than one full-time 11 equivalent position. 12 Sec. 16. 2016 Iowa Acts, House File 2370, is amended by 13 adding the following new section: 14 NEW SECTION . SEC. 3. EFFECTIVE DATE. This Act, being 15 deemed of immediate importance, takes effect upon enactment. 16 Sec. 17. REPEAL. Section 261.61, Code 2016, is repealed. 17 Sec. 18. S.F. _____ H.F. _____ commission, the department for the blind, the department of 1 education, and the state board of regents and its institutions. 2 The bill is organized by divisions. 3 DIVISION I —— FY 2016-2017. The bill appropriates to the 4 department for the blind for its administration. 5 The bill includes appropriations to the college student 6 aid commission for general administrative purposes, the loan 7 repayment program for health care professionals, the national 8 guard educational assistance program, the teacher shortage 9 loan forgiveness program, the all Iowa opportunity foster care 10 grant and scholarship programs, the registered nurse and nurse 11 educator loan forgiveness program, the teach Iowa scholar 12 program, the rural Iowa primary care loan repayment program, 13 and the rural Iowa advanced registered nurse practitioner and 14 physician assistant loan repayment program. 15 The bill modifies the standing appropriations for Iowa 16 tuition grants for students attending nonprofit and for-profit 17 institutions. 18 Code section 261.25 is amended to allow qualified students 19 attending eligible barber and cosmetology schools to qualify 20 for tuition grant moneys that are currently available only to 21 students attending for-profit accredited private institutions 22 located in Iowa. Code section 261.61, which provides for the 23 barber and cosmetology arts and sciences tuition grant program, 24 is repealed. 25 2015 Iowa Acts, HF 2370, relating to exemptions from 26 registration of postsecondary schools by the college student 27 aid commission is amended to make that Act effective upon 28 enactment. The provision takes effect upon enactment and is 29 retroactively applicable to April 6, 2016, the date on which 30 the Governor signed HF 2370. 31 Code section 261.86, concerning the national guard education 32 assistance program, is amended to eliminate a provision 33 that limits the commission’s authority to carryover moneys 34 appropriated for purposes of the program only until one 35 -34- LSB 5013JB (3) 86 kh/tm 34/ 38

The provision takes 2 effect upon enactment and applies retroactively to June 30, 3 2015. 4 The bill appropriates moneys to the department of education 5 for purposes of the department’s general administration, 6 vocational education administration, division of vocational 7 rehabilitation services including independent living programs, 8 the entrepreneurs with disabilities program, and independent 9 living centers, state library for general administration 10 and the enrich Iowa program, public broadcasting division, 11 regional telecommunications councils, vocational education to 12 secondary schools, school food service, early childhood Iowa 13 fund, expansion of the federal Individuals with Disabilities 14 Education Improvement Act birth through age three services, 15 early head start projects, textbooks for nonpublic school 16 pupils, the student achievement and teacher quality program, 17 jobs for America’s graduates specialists, attendance center 18 performance assessment, the beginning administrator mentoring 19 and induction program, the English language literacy for all 20 grant program, the online state job posting system, area 21 education agency support system, successful progression for 22 early readers, an early warning system for literacy, Iowa 23 reading research center, the Iowa online learning initiative, 24 implementation of competency-based education recommendations, 25 distribution to the midwestern higher education compact to pay 26 Iowa’s member state annual obligation, area education agencies, 27 and community colleges. 28 New Code section 256.34 is created, and directs the 29 department of education to establish a fine arts beginning 30 teacher mentoring program under a contract with an Iowa-based 31 nonprofit organization that has membership from the six state 32 fine arts organizations representing K-12 general music, 33 choral music, instrumental music, visual arts, and drama and 34 theater arts educators; and has administered a federally funded 35 -35- LSB 5013JB (3) 86 kh/tm 35/ 38

The bill 1 appropriates $25,000 to the department for the program, which 2 requires the nonprofit organization to match state moneys on a 3 dollar-for-dollar basis. The program must provide activities 4 and consultation in support of beginning fine arts teachers 5 employed in Iowa’s school districts, coordination of retired 6 and currently employed experienced fine arts mentor educators 7 with beginning fine arts educators, and materials and advice 8 specifically designed to prepare beginning fine arts teachers 9 for success in the fine arts classroom and to prepare K-12 10 students for school district fine arts performances and 11 festivals. 12 The nonprofit organization must provide quarterly 13 reports detailing the organization’s compliance with program 14 requirements and the expenditures of moneys for purposes of the 15 program. The director of the department may for good cause 16 suspend, revoke, or refuse to renew a program contract. 17 The new Code section also establishes within the state 18 treasury a fine arts beginning teacher mentoring fund under 19 the control of the department. Moneys in the fund may be used 20 to reimburse mentors for business travel expenses incurred in 21 performance of the mentor’s duties at a rate not to exceed 22 the current rate of reimbursement allowed under the standard 23 method for computation of business travel expenses pursuant to 24 the Internal Revenue Code. Moneys in the account, including 25 interest earned, do not revert to the state general fund. 26 The bill authorizes school districts to use preschool 27 foundation aid funding for the costs of transportation of 28 children participating in the statewide preschool program 29 for four-year-old children, and the costs of transporting 30 other children associated with the program or transported to 31 activities associated with the program may be prorated by 32 school districts. 33 Requirements for teacher licensure are modified to allow 34 an individual to meet the requirements for a teaching license 35 -36- LSB 5013JB (3) 86 kh/tm 36/ 38
S.F. _____ H.F. _____ beyond the initial license if the individual provides evidence 1 of not less than three years of successful teaching experience 2 at an accredited nonpublic school in this state, a preschool 3 program approved by the United States department of health and 4 human services, a community-based provider receiving preschool 5 foundation aid from an approved local program, shared visions 6 and other preschool programs provided under the auspices of 7 or receiving grants from the child development coordinating 8 council under Code section 256A.3, preschool programs receiving 9 moneys from the school ready children grants account of the 10 early childhood Iowa fund created in Code section 256I.11, or 11 an out-of-state K-12 educational institution. The provision 12 takes effect upon enactment. 13 Code section 279.68 is amended to delay until 2018 a 14 requirement that school districts retain a student in 15 grade three if the student has been identified as having a 16 substantial deficiency in reading, the student’s parent or 17 guardian did not enroll the student in an intensive summer 18 reading program, and the student does not qualify for a good 19 cause exemption. The provision requiring school districts to 20 offer each summer, beginning in the summer of 2017, unless 21 the school district receives a waiver from this requirement 22 from the department of education for the summer of 2017, an 23 intensive summer literacy program for students assessed as 24 exhibiting a substantial deficiency in reading, is modified to 25 delay the requirement until the summer of 2018. 26 For consistency, the bill changes a reference from 27 “intensive summer literacy program” to “intensive summer 28 reading program”. 29 Statutory provisions under the student achievement and 30 teacher quality program allocations for national board 31 certification, beginning teacher mentoring and induction, 32 professional development program requirements, teacher quality 33 committees, evaluator training, teacher development academies, 34 and teacher leadership supplemental aid payments, and a teacher 35 -37- LSB 5013JB (3) 86 kh/tm 37/ 38
S.F. _____ H.F. _____ leadership delivery system are modified and the allocation for 1 supplemental assistance for high-need schools is delayed until 2 July 1, 2017. 3 The bill appropriates moneys to the state board of regents 4 for the board office, universities’ general operating budgets; 5 the southwest Iowa regents resource center; the northwest Iowa 6 regents resource center; the quad-cities graduate studies 7 center; Iowa public radio; the state university of Iowa; Iowa 8 state university of science and technology; the university of 9 northern Iowa; and for the Iowa school for the deaf and the 10 Iowa braille and sight saving school, including tuition and 11 transportation costs for students residing in the schools and 12 licensed classroom teachers. 13 DIVISION II —— WORKFORCE TRAINING PROGRAMS —— APPROPRIATIONS 14 FY 2016-2017. The bill appropriates moneys from the Iowa 15 skilled worker and job creation fund to the department of 16 education and the college student aid commission. 17 Up to $200,000 of the moneys deposited in the pathways 18 for academic career and employment fund are allocated to the 19 department for implementation of regional industry sector 20 partnerships and for one full-time equivalent position. 21 -38- LSB 5013JB (3) 86 kh/tm 38/ 38
