Section 89.3, subsection 5, paragraph a, 1 subparagraph (4), subparagraph division (b), Code 2023, is 2 amended to read as follows: 3 (b) The object is an unfired steam pressure vessel and is 4 part of or integral to the continuous operation of a process 5 covered by and compliant with the occupational safety and 6 health administration process safety management standard 7 contained in 29 C.F.R. §1910.119 and the owner demonstrates 8 such compliance to a special inspector or the commissioner. 9 The unfired steam pressure vessel object must also be included 10 as process safety management process equipment in the owner 11 of the unfired steam pressure vessel’s owner’s process safety 12 management program. 13 Sec. 2. Section 89.3, Code 2023, is amended by adding the 14 following new subsection: 15 NEW SUBSECTION . 5A. The owner of an object that meets all 16 of the criteria in subsection 5, paragraph “a” , may request from 17 the commissioner an internal inspection time period of longer 18 than four years, but not to exceed seven years, if the object 19 is an integral part of a continuous operation of a process 20 that is covered by and compliant with the occupational safety 21 and health administration process safety management standard 22 contained in 29 C.F.R. §1910.119 and has a planned outage 23 schedule that is longer than four years. The commissioner 24 shall grant the longer inspection interval if the owner is able 25 to demonstrate to a special inspector or the commissioner that 26 the object is in compliance with the process safety management 27 standard contained in 29 C.F.R. §1910.119 and that the object 28 is included as process safety management process equipment 29 in the owner’s process safety management program. The owner 30 of the object that is granted the longer inspection interval 31 shall comply with the requirements contained in subsection 5, 32 paragraph “b” . 33 EXPLANATION 34 The inclusion of this explanation does not constitute agreement with 35 -1- LSB 1606XC (1) 90 je/rn 1/ 3
S.F. _____ the explanation’s substance by the members of the general assembly. 1 This bill relates to boiler inspections. 2 The bill modifies one of the criteria necessary for a boiler 3 or pressure vessel to be inspected at least once each year 4 externally while under pressure and at least once every four 5 years internally while not under pressure, unless the labor 6 commissioner determines an earlier inspection is warranted. 7 Under current law, one of the criteria for an unfired steam 8 pressure vessel to be eligible for such an inspection schedule 9 is that the vessel is part of or integral to the continuous 10 operation of a process covered by and compliant with a 11 specified occupational safety and health administration 12 process safety management standard, and the owner demonstrates 13 such compliance to a special inspector or the commissioner. 14 Additionally, the vessel must also be included as process 15 safety management process equipment in the owner of the unfired 16 steam pressure vessel’s process safety management program. The 17 bill provides that this criterion is not limited to unfired 18 steam pressure vessels, but includes any boiler or pressure 19 vessel. 20 The bill also authorizes the owner of a boiler or pressure 21 vessel meeting certain criteria as specified in the bill to 22 request from the commissioner an internal inspection time 23 period of longer than four years, but not to exceed seven 24 years, if the boiler or vessel is an integral part of a 25 continuous operation of a process that is covered by and 26 compliant with a specified occupational safety and health 27 administration process safety management standard and has a 28 planned outage schedule that is longer than four years. The 29 commissioner shall grant the longer inspection interval if the 30 owner is able to demonstrate to a special inspector or the 31 commissioner that the object is in compliance with the process 32 safety management standard and that the object is included as 33 process safety management process equipment in the owner’s 34 process safety management program.
