Senate Joint Resolution 4 - Introduced SENATE JOINT RESOLUTION BY D. JOHNSON SENATE JOINT RESOLUTION 1 A Joint Resolution proposing an amendment to the Constitution 2 of the State of Iowa providing that the people of the state 3 have a right to hunt, fish, and harvest wildlife. 4 BE IT RESOLVED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: TLSB 1968XS (2) 87 av/rj PAG LIN 1 1 Section 1. The following amendment to the Constitution of 1 2 the State of Iowa is proposed: 1 3 Article I of the Constitution of the State of Iowa is amended 1 4 by adding the following new section: 1 5 Right to hunt, fish, and harvest wildlife.SEC. 24A. 1 6 1. The citizens of this state have the right to hunt, fish, 1 7 and harvest wildlife, including by the use of traditional 1 8 methods, subject to reasonable laws enacted by the general 1 9 assembly and reasonable rules adopted by the state executive 1 10 branch to promote wildlife conservation and management, to 1 11 maintain natural resources held in trust by the state for 1 12 public use, and to preserve the future of hunting, fishing, and 1 13 harvesting wildlife. 1 14 2. Public hunting, fishing, and harvesting of wildlife 1 15 shall be a preferred means of managing and controlling 1 16 wildlife. 1 17 3. This section shall not be construed to modify any 1 18 provision of law relating to eminent domain, trespass, or 1 19 property rights. 1 20 Sec. 2. REFERRAL AND PUBLICATION. The foregoing proposed 1 21 amendment to the Constitution of the State of Iowa is referred 1 22 to the general assembly to be chosen at the next general 1 23 election for members of the general assembly and the secretary 1 24 of state is directed to cause it to be published for three 1 25 consecutive months before the date of the election as provided 1 26 by law. 1 27 EXPLANATION 1 28 The inclusion of this explanation does not constitute agreement with 1 29 the explanation's substance by the members of the general assembly. 1 30 This joint resolution proposes an amendment to the 1 31 Constitution of the State of Iowa providing that the citizens 1 32 of this state have the right to hunt, fish, and harvest 1 33 wildlife, using traditional methods, subject to reasonable laws 1 34 enacted by the general assembly and reasonable rules adopted 1 35 by the state executive branch to promote wildlife conservation 2 1 and management, to maintain natural resources held in trust 2 2 by the state for public use, and to preserve the future of 2 3 hunting, fishing, and harvesting wildlife. The proposed 2 4 amendment further states that hunting, fishing, and harvesting 2 5 wildlife shall be a preferred means of managing and controlling 2 6 wildlife and that the proposed amendment shall not be construed 2 7 to modify any provision of law relating to eminent domain, 2 8 trespass, or property rights. 2 9 The proposed amendment, if adopted, would be referred to the 2 10 next general assembly for adoption a second time, before being 2 11 submitted to the electorate for ratification.
