Bill Title: A bill for an act relating to and making appropriations to the education system, including the funding and operation of the department for the blind, the department of education, and the state board of regents; requiring the state board of regents to conduct a study and prepare a report related to diversity, equity, and inclusion programs and efforts; providing for responsibilities of the workforce development board; establishing the Iowa workforce grant and incentive program; requiring the department of education to convene a task force to study issues related to programs for at-risk students and dropout prevention programs; modifying provisions related to the future ready Iowa skilled workforce grant program, the all Iowa opportunity scholarship program, the education savings account program, the gap tuition assistance program, the Iowa educational services for the blind and visually impaired program, career and technical education programs, the fine arts beginning teacher mentoring program, the equipment replacement and program-sharing property tax levy, and the posting of education-related job openings; and including effective date, applicability, and retroactive applicability provisions. EARLY WARNING SYSTEM FOR LITERACY 7 a. For purposes of purchasing a statewide license for an 8 early warning assessment and administering the early warning 9 system for literacy established in accordance with section 10 279.68 and rules adopted in accordance with section 256.7, 11 subsection 31 : 12 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 1,915,000 13 b. The department shall administer and distribute to school 14 districts and accredited nonpublic schools the early warning 15 assessment system that allows teachers to screen and monitor 16 student literacy skills from prekindergarten through grade 17 six. The department may charge school districts and accredited 18 nonpublic schools a fee for the system not to exceed the actual 19 costs to purchase a statewide license for the early warning 20 assessment minus the moneys received by the department under 21 this subsection. The fee shall be determined by dividing the 22 actual remaining costs to purchase the statewide license for 23 the school year by the number of pupils assessed under the 24 system in the current fiscal year. School districts may use 25 moneys received pursuant to section 257.10, subsection 11 , and 26 moneys received for purposes of implementing section 279.68, 27 subsection 2 , to pay the early warning assessment system fee. 28 16. IOWA READING RESEARCH CENTER 29 a. For purposes of the Iowa reading research center in 30 order to implement, in collaboration with the area education 31 agencies, the provisions of section 256.9, subsection 49 , 32 paragraph “c”: 33 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 1,500,000 34 b. S.F. 560 than $250,000 shall be used for collaborations with the state 1 board of education relating to the approval of practitioner 2 preparation programs pursuant to section 256.7, subsection 3 , 3 paragraph “c”, and with the board of educational examiners for 4 the establishment and continuing oversight of the advanced 5 dyslexia specialist endorsement pursuant to section 272.2, 6 subsection 22 , as amended by 2023 Iowa Acts, Senate File 514. 7 For the fiscal year beginning July 1, 2023, and ending June 30, 8 2024, the center shall submit a report to the general assembly 9 detailing the expenditures of moneys used for purposes of this 10 paragraph “b”. 11 c. Notwithstanding section 8.33 , moneys received by the 12 department pursuant to this subsection that remain unencumbered 13 or unobligated at the close of the fiscal year shall not revert 14 but shall remain available for expenditure for the purposes 15 specified in this subsection until the close of the succeeding 16 fiscal year. 17 17. COMPUTER SCIENCE PROFESSIONAL DEVELOPMENT INCENTIVE 18 FUND 19 For deposit in the computer science professional development 20 incentive fund established under section 284.6A : 21 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 500,000 22 18. For the fiscal year 2 beginning July 1, 2023, and ending June 30, 2024, the health 3 care organization receiving moneys pursuant to this paragraph 4 shall prepare a report, in collaboration with the department 5 of education, detailing the expenditures of moneys used for 6 the purposes of this program and its outcomes, which shall be 7 submitted to the general assembly by September 30, 2024. 8 19. BEST BUDDIES IOWA 9 a. For school districts to create opportunities for 10 one-to-one friendships, integrated employment, and leadership 11 development for students with intellectual and developmental 12 disabilities: 13 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 35,000 14 b. MIDWESTERN HIGHER EDUCATION COMPACT 22 a. Except as otherwise provided in this subsection, the 31 moneys appropriated in this subsection shall be expended for 32 salaries, staffing, institutional support, activities directly 33 related to recruitment of kindergarten through grade 12 34 mathematics and science teachers, and for ongoing mathematics 35 -9- SF 560 (3) 90 jda/ns/mb 9/ 40
S.F. 560 and science programming for students enrolled in kindergarten 1 through grade 12. 2 b. The department shall work with the community colleges to 3 develop STEM professional development programs for community 4 college instructors and STEM curriculum development. 5 c. From the moneys appropriated in this subsection, not less 6 than $500,000 shall be used to provide technology education 7 opportunities to high school, career academy, and community 8 college students through a public-private partnership, as 9 well as opportunities for students and faculties at these 10 institutions to secure broad-based information technology 11 certification. The partnership shall provide all of the 12 following: 13 (1) A research-based curriculum. 14 (2) Online access to the curriculum. 15 (3) Instructional software for classroom and student use. 16 (4) Certification of skills and competencies in a broad base 17 of information technology-related skill areas. 18 (5) Professional development for teachers. 19 (6) Deployment and program support, including but not 20 limited to integration with current curriculum standards. 21 d. Notwithstanding section 8.33 , of the moneys appropriated 22 in this subsection that remain unencumbered or unobligated at 23 the close of the fiscal year, an amount equivalent to not more 24 than 5 percent of the amount appropriated in this subsection 25 shall not revert but shall remain available for expenditure for 26 summer programs for students until the close of the succeeding 27 fiscal year. 28 26. For 12 the fiscal year beginning July 1, 2023, and ending June 30, 13 2024, the state board of regents may use notes, bonds, or 14 other evidences of indebtedness issued under section 262.48 to 15 finance projects that will result in energy cost savings in an 16 amount that will cause the state board to recover the cost of 17 the projects within an average of six years. 18 DIVISION IV 19 STANDING APPROPRIATIONS 20 Sec. 8. AT-RISK CHILDREN. Notwithstanding the standing 21 appropriation in section 279.51 for the fiscal year beginning 22 July 1, 2023, and ending June 30, 2024, the amount appropriated 23 from the general fund of the state to the department of 24 education for programs for at-risk children under section 25 279.51 shall be not more than $10,524,389. The amount of any 26 reduction in this section shall be prorated among the programs 27 specified in section 279.51, subsection 1 , paragraphs “a”, “b”, 28 and “c”. 29 Sec. 9. WORK-STUDY APPROPRIATION. Notwithstanding section 30 261.85, as amended by 2023 Iowa Acts, Senate File 514, for the 31 fiscal year beginning July 1, 2023, and ending June 30, 2024, 32 the amount appropriated from the general fund of the state 33 to the college student aid commission of the department of 34 education for the work-study program under section 261.85, as 35 -21- SF 560 (3) 90 jda/ns/mb 21/ 40
S.F. 560 amended by 2023 Iowa Acts, Senate File 514, shall be zero. 1 Sec. 10. Section 261.25, subsections 1 and 2, Code 2023, are 2 amended to read as follows: 3 1. There is appropriated from the general fund of the state 4 to the commission for each fiscal year the sum of fifty million 5 one hundred eighteen thousand four hundred fifty-one million 6 four hundred twenty-one thousand five hundred thirty-one 7 dollars for tuition grants to qualified students who are 8 enrolled in accredited private institutions. 9 2. There is appropriated from the general fund of the state 10 to the commission for each fiscal year the sum of five hundred 11 one hundred eight thousand dollars for tuition grants for 12 qualified students who are enrolled in eligible institutions. 13 Of the moneys appropriated under this subsection , not more than 14 one hundred thousand dollars annually shall be used for tuition 15 grants to qualified students who are attending an eligible 16 institution under section 261.9, subsection 3 , paragraph “b” . 17 DIVISION V 18 DIVERSITY, EQUITY, AND INCLUSION 19 Sec. 11. DIVERSITY, EQUITY, AND INCLUSION EFFORTS —— STUDY 20 —— HIRING FREEZE —— USE OF MONEYS. 21 1. The state board of regents shall conduct a comprehensive 22 study and review of the diversity, equity, and inclusion 23 programs and efforts of each institution of higher learning 24 under the state board’s control. The study and review must 25 include but is not limited to an assessment of all of the 26 following: 27 a. Each institution of higher learning’s current diversity, 28 equity, and inclusion programming, curricula, training, and 29 related activities. 30 b. The salary, benefits, and any other compensation paid to 31 employees or individuals tasked with furthering an institution 32 of higher learning’s diversity, equity, and inclusion efforts. 33 c. Each institution of higher learning’s compliance with 34 required applicable federal and state laws, rules, regulations, 35 -22- SF 560 (3) 90 jda/ns/mb 22/ 40
S.F. 560 court orders, settlement agreements, or executive orders 1 related to diversity, equity, and inclusion. 2 d. Each institution of higher learning’s contracts or 3 grants requiring diversity, equity, and inclusion efforts, 4 and the requirements of third-party accreditors or similar 5 entities in order to assess whether and to what extent these 6 efforts are aligned with the overall mission and purpose of the 7 institution. 8 2. The state board of regents shall prepare a report 9 containing its findings and recommendations to be considered 10 by the state board during its November 2023 meeting. The 11 state board of regents shall submit a final report containing 12 findings and recommendations to the governor and the general 13 assembly no later than December 1, 2023. 14 3. For the fiscal year beginning July 1, 2023, and ending 15 June 30, 2024, each institution of higher learning under the 16 control of the state board of regents shall cease all hiring 17 related to the institution’s diversity, equity, and inclusion 18 efforts. 19 DIVISION VI 20 IOWA WORKFORCE GRANT AND INCENTIVE PROGRAM 21 Sec. 12. Section 84A.1B, Code 2023, is amended by adding the 22 following new subsection: 23 NEW SUBSECTION . 17. Create, in collaboration with the state 24 board of regents, a list of high-wage and high-demand jobs and 25 corresponding academic majors offered by institutions of higher 26 education governed by the state board of regents for purposes 27 of the Iowa workforce grant and incentive program established 28 under section 256.230. The workforce development board, in 29 collaboration with the state board of regents, shall update the 30 list at least once every two years. In creating a list under 31 this subsection, the following criteria, at a minimum, apply: 32 a. An entry-level annual salary of not less than forty 33 thousand dollars. 34 b. Educational attainment of a qualifying credential of 35 -23- SF 560 (3) 90 jda/ns/mb 23/ 40
S.F. 560 at least a bachelor’s degree, or attainment of an initial or 1 intern Iowa teaching license issued under chapter 256 through 2 a pathway to licensure offered by an institution of higher 3 education under the control of the state board of regents or an 4 accredited private institution as defined in section 261.9. 5 c. At least one of any of the following: 6 (1) Projected annual job openings of at least two hundred 7 fifty during the next five years. 8 (2) Projected annual growth in the number of job openings 9 of at least one percent. 10 Sec. 13. NEW SECTION . 256.230 Iowa workforce grant and 11 incentive program. 12 1. Definitions. As used in this section, unless the context 13 otherwise requires: 14 a. “Commission” means the college student aid commission. 15 b. “Eligible institution” means an institution of higher 16 learning governed by the state board of regents. 17 c. “Eligible program” means any of the following: 18 (1) A program of study or an academic major jointly approved 19 by the workforce development board and the state board of 20 regents pursuant to section 84A.1B, subsection 17. If a 21 job is removed from the list created under section 84A.1B, 22 subsection 17, an eligible student who received a grant for 23 a program based on that job shall continue to receive the 24 grant until the eligible program is completed as long as the 25 student continuously enrolls and continues to meet all other 26 eligibility requirements. 27 (2) A teacher preparation program that leads to a bachelor’s 28 degree, or initial or intern teaching license issued under this 29 chapter. 30 d. “Eligible student” means an Iowa resident who has 31 established financial need and who meets all of the following 32 requirements: 33 (1) Completes and submits application forms required by the 34 commission, including the free application for federal student 35 -24- SF 560 (3) 90 jda/ns/mb 24/ 40
S.F. 560 aid, by the deadline prescribed by the commission. 1 (2) Enrolls in at least three semester hours, or the 2 equivalent, in an eligible program. 3 (3) Is making satisfactory academic progress as defined by 4 the eligible institution. 5 e. “Financial need” means the difference between the 6 student’s financial resources available, including those 7 available from the student’s parents as determined by a 8 completed parents’ confidential statement, and the student’s 9 anticipated expenses while attending an eligible institution. 10 f. “Full-time” means enrollment in at least twelve semester 11 hours or the equivalent. 12 g. “Part-time” means enrollment in at least three semester 13 hours or the equivalent but less than twelve semester hours or 14 the equivalent. 15 2. Student eligibility. An eligible institution shall 16 report promptly to the commission information requested to 17 establish or verify student eligibility. 18 3. Grant limitations —— requirements. 19 a. A full-time eligible student may receive an Iowa 20 workforce grant for not more than four semesters, or the 21 equivalent, or until the eligible student completes the 22 eligible program, whichever occurs first. A part-time 23 eligible student may receive the grant for not more than eight 24 semesters, or the equivalent, on a prorated basis, or until 25 the eligible student completes the eligible program, whichever 26 occurs first. 27 b. The amount of an Iowa workforce grant to a full-time 28 eligible student shall not exceed two thousand dollars per 29 semester, or the equivalent. The amount of an Iowa workforce 30 grant to a part-time eligible student shall be equal to the 31 amount that would be awarded to a full-time student except that 32 the commission shall prorate the amount based on the recipient 33 student’s semester hour or equivalent enrollment. 34 c. An Iowa workforce grant shall be awarded on an annual 35 -25- SF 560 (3) 90 jda/ns/mb 25/ 40
S.F. 560 basis, requiring reapplication by an eligible student each 1 year. Payments under the grant shall be allocated equally 2 among the semesters, or the equivalent, and paid upon 3 certification by the eligible institution that the student 4 meets the requirements of subsection 1, paragraph “d” . 5 d. If a grant recipient discontinues attendance before the 6 end of any semester, or the equivalent, after receiving grant 7 payments, the entire amount of any refund due that recipient, 8 up to the full amount of grant payments made during that 9 semester, or the equivalent, shall be paid by the eligible 10 institution to the commission. 11 4. Annual submission of applications. To receive a renewal 12 of a grant awarded under this section, an eligible student 13 must annually submit a new application to the commission for 14 reevaluation of eligibility. 15 5. Priority for grant awards. In making awards under this 16 section, the commission shall give priority to: 17 a. Applicants who received an award under this section in 18 the prior academic year. 19 b. Applicants with the least financial ability to pay, 20 using a metric that ranks relative financial ability among all 21 applicants. 22 6. Iowa workforce incentive payment. Notwithstanding the 23 grant limitations in subsection 3, an individual who was an 24 eligible student who received an Iowa workforce grant in the 25 academic year in which the eligible program is completed, and 26 who accepts and begins employment in an aligned occupation 27 in this state within six months of completing the eligible 28 program, may apply for one incentive payment of up to two 29 thousand dollars. The incentive payment shall be paid upon 30 completion of twelve consecutive months of full-time employment 31 in the aligned occupation in this state, following completion 32 of the eligible program. 33 7. Commission’s duties and responsibilities. Subject to an 34 appropriation of moneys by the general assembly for purposes 35 -26- SF 560 (3) 90 jda/ns/mb 26/ 40
S.F. 560 of this section, the commission shall administer the Iowa 1 workforce grant and incentive program and shall do all of the 2 following: 3 a. Provide application forms for distribution to students by 4 eligible institutions. 5 b. Adopt rules under chapter 17A for administration of this 6 section, including establishing the duties and responsibilities 7 of eligible institutions under the program, defining residence 8 and satisfactory academic progress for purposes of the program, 9 determining financial need, and establishing procedures for 10 grant and incentive payment application, processing, and 11 approval. The rules shall provide for determining the priority 12 awarding of grants and incentives if moneys available for 13 purposes of this section are insufficient to pay all eligible 14 applicants. 15 c. Approve and award grants and incentive payments on an 16 annual basis. 17 8. Fund created. An Iowa workforce grant and incentive 18 program fund is created in the state treasury under the control 19 of the commission. All moneys deposited or paid into the 20 fund are appropriated to the commission to be used for grants 21 and incentive payments awarded as provided in this section. 22 Notwithstanding section 8.33, moneys in the fund that remain 23 unencumbered or unobligated at the close of a fiscal year shall 24 not revert but shall remain available for expenditure for the 25 purposes designated. Notwithstanding section 12C.7, subsection 26 2, interest or earnings on moneys in the fund shall be credited 27 to the fund. 28 DIVISION VII 29 DEPARTMENT OF EDUCATION —— TASK FORCE 30 Sec. 14. DEPARTMENT OF EDUCATION —— FUNDING FOR AT-RISK 31 STUDENTS AND DROPOUT PREVENTION PROGRAMS —— TASK FORCE. 32 1. The department of education shall convene and provide 33 administrative support to a task force that shall study all of 34 the following: 35 -27- SF 560 (3) 90 jda/ns/mb 27/ 40
S.F. 560 a. How schools currently utilize state funding for programs 1 for at-risk students and dropout prevention programs. 2 b. The effectiveness of programs for at-risk students and 3 dropout prevention programs. 4 c. Whether and to what extent state funding for programs 5 for at-risk students and dropout prevention programs should 6 be reallocated to direct intervention by a jobs for America’s 7 graduates specialist. 8 d. How to best utilize state funding for programs for 9 at-risk students and dropout prevention programs. 10 2. Any expenses incurred by a member of the task force 11 shall be the responsibility of the individual member or the 12 respective entity represented by the member. 13 3. The task force shall submit its findings and 14 recommendations to the general assembly in a report by December 15 31, 2023. 16 DIVISION VIII 17 FUTURE READY IOWA SKILLED WORKFORCE GRANT PROGRAM 18 Sec. 15. Section 261.132, subsections 1 and 2, Code 2023, 19 are amended to read as follows: 20 1. Definitions. As used in this section , unless the context 21 otherwise requires: 22 a. “Approved virtual institution” means a nonprofit 23 institution of higher learning that satisfies all of the 24 following requirements: 25 (1) Is accredited by a national accrediting agency 26 recognized by the United States department of education. 27 (2) Provides instruction using exclusively a 28 competency-based educational model. 29 (3) Adopts a policy to require that the nonprofit 30 institution of higher learning shall, by December 15 of each 31 year, file a report with the governor and the general assembly 32 providing information and statistics for the previous five 33 academic years on the number of Iowa resident students per year 34 who are veterans who received education credit for military 35 -28- SF 560 (3) 90 jda/ns/mb 28/ 40
S.F. 560 education, training, and service, that number as a percentage 1 of veterans known to be enrolled at the nonprofit institution 2 of higher learning, the average number of credits received by 3 students, and the average number of credits applied towards the 4 award or completion of a course of instruction, postsecondary 5 diploma, degree, or other evidences of distinction. For 6 purposes of this subparagraph, “veteran” means a veteran as 7 defined in section 35.1 or a member of the reserve forces 8 of the United States or the national guard as defined in 9 section 29A.1 who has served at least one year of the member’s 10 commitment and is eligible for or has exhausted federal 11 veterans education benefits under 38 U.S.C. ch. 30, 32, 33, or 12 36, or 10 U.S.C. ch. 1606 or 1607, respectively. 13 a. b. “Commission” means the college student aid 14 commission. 15 b. c. “Eligible institution” means an institution of 16 higher learning governed by the state board of regents , or an 17 accredited private institution as defined in section 261.9 , 18 or an approved virtual institution, that meets all of the 19 following criteria: 20 (1) Applies to and is approved by the commission to 21 participate in the future ready Iowa skilled workforce grant 22 program. 23 (2) Requires eligible students to complete and file 24 application forms required by the commission, apply for 25 all available state and federal financial aid, apply to the 26 eligible institution to participate in the program, attend 27 orientation in person or virtually, register for classes 28 with the assistance of an academic advisor, and participate 29 in academic and career advising sessions required under the 30 program. 31 (3) Certifies that prior to participating in the program 32 an eligible student has earned at least half of the credits 33 necessary for a bachelor’s degree and is able to complete a 34 bachelor’s degree in an eligible program of study or academic 35 -29- SF 560 (3) 90 jda/ns/mb 29/ 40
S.F. 560 major leading to a designated high-demand job in the prescribed 1 grant time frame. 2 (4) (3) Facilitates the assignment of a volunteer mentor 3 or a mentor who is a member of the faculty of the eligible 4 institution to each eligible student based on the eligible 5 student’s interest. The A volunteer mentor shall have 6 successfully passed a background investigation and a check of 7 the national sex offender registry as required under section 8 15H.10, subsection 2 , and both the eligible student and the 9 volunteer mentor shall have entered into a written agreement as 10 provided in section 15H.10, subsection 3 . 11 (5) (4) Facilitates connections through campus career 12 centers and services to internships and similar local, state, 13 and federal programs. 14 (6) (5) Markets the eligible institution’s eligible 15 program and optional incentives, which may include but not be 16 limited to credit for military experience, on the eligible 17 institution’s internet site and to other relevant agencies 18 and organizations as recommended by the college student 19 aid commission, the commission on volunteer service, or the 20 department of workforce development. 21 (7) (6) Submits annually information and data regarding 22 the eligible program operated by the eligible institution, the 23 students and volunteer mentors participating in the eligible 24 program, and statistics on employment outcomes for eligible 25 program participants by industry, to the commission in the 26 manner required by the commission. 27 c. d. “Eligible program” means a program of study or an 28 academic major jointly approved by the commission and the 29 department of workforce development, in consultation with the 30 eligible institution, that leads to a bachelor’s degree aligned 31 with a high-demand job designated by the workforce development 32 board pursuant to section 84A.1B, subsection 14 . If the 33 department removes a high-demand job from the list created 34 under section 84A.1B, subsection 14 , an eligible student who 35 -30- SF 560 (3) 90 jda/ns/mb 30/ 40
S.F. 560 received a grant for a program based on that high-demand 1 job shall continue to receive the grant until achieving a 2 bachelor’s degree as long as the student continues to meet all 3 other eligibility requirements. 4 d. e. “Eligible student” means an Iowa resident who meets 5 all of the following requirements: 6 (1) Has earned at least half of the credits necessary for a 7 bachelor’s degree and is able to complete a bachelor’s degree 8 in an eligible program of study or academic major leading to a 9 designated high-demand job in the prescribed grant time frame. 10 (2) (1) Completes and submits application forms required 11 by the commission, including the free application for federal 12 student aid; applies for all available state and federal 13 financial aid; attends orientation in person or virtually; 14 registers for classes with the assistance of an academic 15 advisor; and participates in academic and career advising 16 sessions required under the eligible program. To receive a 17 renewal of a grant awarded under this section , an eligible 18 student must annually submit a new application to the 19 commission for reevaluation of eligibility. 20 (3) Has not been enrolled in postsecondary education 21 during the twenty-four months preceding the date on which the 22 commission receives the individual’s application to participate 23 in the program. 24 (2) Is at least twenty-five years of age at the time the 25 individual enrolls in an eligible program. 26 (4) (3) Enrolls in at least six semester hours, or the 27 equivalent, in an eligible program. However, an eligible 28 student may enroll in fewer than six semester hours, or the 29 equivalent, if the eligible student needs fewer than six 30 semester hours of credit, or the equivalent, to achieve a 31 bachelor’s degree under the eligible program. 32 (5) (4) Is making satisfactory academic progress as defined 33 by the eligible institution. 34 (6) (5) Remains continuously enrolled unless granted a 35 -31- SF 560 (3) 90 jda/ns/mb 31/ 40
S.F. 560 leave of absence by the eligible institution based on criteria 1 adopted by rule by the commission. 2 e. f. “Full-time” means enrollment in at least twelve 3 semester hours or the equivalent. 4 f. g. “Part-time” means enrollment in at least six but less 5 than twelve semester hours or the equivalent. 6 2. Allowable activities. An eligible student may work with 7 an assigned volunteer mentor , or a mentor who is a member of 8 the faculty of the eligible institution, to help the student 9 meet the requirements of this section or the requirements of 10 an eligible program, identify and participate in work-based 11 learning opportunities with the approval of the eligible 12 institution, and make other career-related connections. 13 Sec. 16. Section 261.132, subsection 3, paragraph c, Code 14 2023, is amended to read as follows: 15 c. A future ready Iowa skilled workforce grant shall be 16 awarded on an annual basis, requiring reapplication by an 17 eligible student each year. Payments under the grant shall be 18 allocated equally among the semesters, or the equivalent, and 19 paid upon certification by the eligible institution that the 20 student meets the requirements of subsection 1 , paragraph “d” 21 “e” . 22 Sec. 17. Section 261.132, subsection 4, paragraph d, Code 23 2023, is amended to read as follows: 24 d. Transmit to the department of workforce development the 25 compilation of information, data, and statistics submitted in 26 accordance with subsection 1 , paragraph “b” “c” , subparagraph 27 (7) (6) , for the annual report required under section 84A.1B . 28 Sec. 18. Section 261.132, subsection 6, Code 2023, is 29 amended by striking the subsection. 30 Sec. 19. APPROVED VIRTUAL INSTITUTIONS —— 31 APPLICATIONS. For the fiscal year beginning July 1, 2023, and 32 ending June 30, 2024, an approved virtual institution may apply 33 to the college student aid commission to participate in the 34 future ready Iowa skilled workforce grant program established 35 -32- SF 560 (3) 90 jda/ns/mb 32/ 40
S.F. 560 pursuant to section 261.132 in the current academic year. 1 DIVISION IX 2 ALL IOWA OPPORTUNITY SCHOLARSHIP PROGRAM 3 Sec. 20. Section 261.87, subsection 1, paragraph b, 4 unnumbered paragraph 1, Code 2023, is amended to read as 5 follows: 6 “Eligible foster care student” means a person under 7 twenty-six years of age who has a high school diploma or a high 8 school equivalency diploma under chapter 259A and is described 9 by any of the following: 10 Sec. 21. Section 261.87, subsection 2, paragraph f, Code 11 2023, is amended to read as follows: 12 f. (1) Begins Except as provided in subparagraph (2), 13 begins enrollment at an eligible institution within two 14 academic years of graduation from high school or receipt of 15 a high school equivalency diploma under chapter 259A and 16 continuously receives awards as a full-time or part-time 17 student to maintain eligibility. However, the student may 18 defer or suspend participation in the program for up to two 19 years in order to pursue obligations that meet conditions 20 established by the commission by rule or to fulfill military 21 obligations. 22 (2) The requirements of subparagraph (1) do not apply to an 23 eligible foster care student. 24 Sec. 22. APPLICABILITY. This division of this Act applies 25 to applications submitted under the all Iowa opportunity 26 scholarship program established pursuant to section 261.87 27 before, on, or after the effective date of this division of 28 this Act. 29 DIVISION X 30 EDUCATION SAVINGS ACCOUNTS —— CORRECTIONS 31 Sec. 23. Section 257.11B, subsection 2, paragraph a, 32 subparagraph (1), subparagraph division (c), as enacted by 2023 33 Iowa Acts, House File 68, section 7, is amended to read as 34 follows: 35 -33- SF 560 (3) 90 jda/ns/mb 33/ 40
S.F. 560 (c) A resident pupil who is eligible to enroll in grades one 1 through twelve and was enrolled in a nonpublic school for the 2 school year immediately preceding the school year for which the 3 education savings account payment is requested if the pupil’s 4 household has an annual income less than or equal to three 5 hundred percent of the most recently revised poverty income 6 guidelines published by the United States department of health 7 and human services. 8 Sec. 24. Section 257.46, subsection 3, Code 2023, as amended 9 by 2023 Iowa Acts, House File 68, section 16, is amended to 10 read as follows: 11 3. If any portion of the gifted and talented program budget 12 remains unexpended at the end of the budget year, the remainder 13 shall be carried over to the subsequent budget year and added 14 to the gifted and talented program budget for that year. At 15 the end of a fiscal year beginning on or after July 1, 2022, 16 the school district may use all or a portion of funds for 17 the purposes authorized under section 257.10, subsection 9, 18 paragraph “d” . 19 Sec. 25. EFFECTIVE DATE. This division of this Act, being 20 deemed of immediate importance, takes effect upon enactment. 21 Sec. 26. RETROACTIVE APPLICABILITY. This division of this 22 Act applies retroactively to January 24, 2023. 23 DIVISION XI 24 EDUCATION SAVINGS ACCOUNTS —— DEPOSIT OF MONEYS 25 Sec. 27. EDUCATION SAVINGS ACCOUNTS —— DEPOSIT OF 26 MONEYS. Notwithstanding any other provision of law to the 27 contrary, for the fiscal year beginning July 1, 2023, and 28 ending June 30, 2024, moneys in the education savings account 29 fund established in section 257.11B, as enacted by 2023 Iowa 30 Acts, House File 68, may be deposited into an account at any 31 financial institution, including but not limited to financial 32 institutions outside the state of Iowa, if such deposits 33 are adequately protected and necessary for the effective 34 administration of the education savings account program. All 35 -34- SF 560 (3) 90 jda/ns/mb 34/ 40
S.F. 560 liability protections of sections 12C.8 and 12C.24 apply in 1 connection with any such deposits as if the deposits were made 2 in compliance with chapter 12C. 3 DIVISION XII 4 GAP TUITION ASSISTANCE 5 Sec. 28. Section 260I.3, subsections 2 and 5, Code 2023, are 6 amended by striking the subsections. 7 Sec. 29. Section 260I.4, subsections 1, 5, 6, and 7, Code 8 2023, are amended by striking the subsections. 9 Sec. 30. Section 260I.5, subsection 2, Code 2023, is amended 10 to read as follows: 11 2. Direct training costs and support services . 12 Sec. 31. Section 260I.6, subsection 1, unnumbered paragraph 13 1, Code 2023, is amended to read as follows: 14 The program is not offered for credit, but is aligned with 15 a certificate, diploma, or degree for credit, is either not 16 offered for credit or is offered for short-term credit that is 17 not eligible under the federal Pell grant program, and does any 18 of the following: 19 Sec. 32. REPEAL. Section 260I.7, Code 2023, is repealed. 20 DIVISION XIII 21 STATE GOVERNMENT REALIGNMENT —— MODIFICATIONS 22 Sec. 33. Section 256.103, as enacted by 2023 Iowa Acts, 23 Senate File 514, section 2480, is amended to read as follows: 24 256.103 Employees —— contracts —— termination and discharge 25 procedures. 26 Sections 279.12 through 279.19 and section 279.27 apply to 27 employees of the Iowa educational services for the blind and 28 visually impaired program and employees of the Iowa school for 29 the deaf, who are licensed pursuant to subchapter VII, part 3. 30 In following those sections in chapter 279, the references to 31 boards of directors of school districts shall be interpreted to 32 apply to the department. 33 Sec. 34. Section 258.6, subsection 1, Code 2023, as amended 34 by 2023 Iowa Acts, Senate File 514, section 2529, is amended 35 -35- SF 560 (3) 90 jda/ns/mb 35/ 40
S.F. 560 to read as follows: 1 1. “Approved career and technical education program” means 2 a career and technical education program offered by a school 3 district or community college and approved by the bureau 4 department which meets the standards for career and technical 5 education programs adopted by the state board under this part. 6 Sec. 35. 2023 Iowa Acts, Senate File 514, section 2514, 7 subsection 1, is amended to read as follows: 8 1. The property and records in the custody of the state 9 board of regents relating to the Iowa braille and sight saving 10 school, the Iowa school for the deaf, the Iowa educational 11 services for the blind and visually impaired program, the hall 12 of fame for distinguished graduates at the Iowa braille and 13 sight saving school, and the hall of fame for distinguished 14 graduates at the Iowa school for the deaf shall be transferred 15 to the department of education. 16 DIVISION XIV 17 STATE PROGRAM ALLOCATION —— FINE ARTS BEGINNING TEACHER 18 MENTORING PROGRAM 19 Sec. 36. Section 256.34, subsection 2, Code 2023, is amended 20 to read as follows: 21 2. Program criteria shall include a required match of one 22 dollar provided by the organization contracting to deliver 23 services under subsection 1 for each dollar provided to the 24 organization by the department. Moneys in the fund established 25 under subsection 6 shall not be disbursed until the department 26 receives evidence that the organization meets or will meet 27 the match requirement. The department may consider in-kind 28 contributions received by the organization for matching 29 purposes. 30 Sec. 37. Section 284.13, subsection 1, paragraphs a, b, c, 31 e, f, and g, Code 2023, are amended to read as follows: 32 a. For the fiscal year beginning July 1, 2022 2023 , and 33 ending June 30, 2023 2024 , to the department, the amount of 34 five hundred eight thousand two hundred fifty dollars for the 35 -36- SF 560 (3) 90 jda/ns/mb 36/ 40
S.F. 560 issuance of national board certification awards in accordance 1 with section 256.44 . Of the amount allocated under this 2 paragraph, not less than eighty-five thousand dollars shall 3 be used to administer the ambassador to education position in 4 accordance with section 256.45 . 5 b. For the fiscal year beginning July 1, 2022 2023 , and 6 ending June 30, 2023 2024 , up to seven hundred twenty-eight 7 thousand two hundred sixteen dollars to the department for 8 purposes of implementing the professional development program 9 requirements of section 284.6 , assistance in developing model 10 evidence for teacher quality committees established pursuant to 11 section 284.4, subsection 1 , paragraph “b” , and the evaluator 12 training program in section 284.10 . A portion of the funds 13 allocated to the department for purposes of this paragraph may 14 be used by the department for administrative purposes and for 15 not more than four full-time equivalent positions. 16 c. For the fiscal year beginning July 1, 2022 2023 , 17 and ending June 30, 2023 2024 , an amount up to one million 18 seventy-seven thousand eight hundred ten dollars to the 19 department for the establishment of teacher development 20 academies in accordance with section 284.6, subsection 10 . A 21 portion of the funds allocated to the department for purposes 22 of this paragraph may be used for administrative purposes. 23 e. For the fiscal year beginning July 1, 2022 2023 , and 24 ending June 30, 2023 2024 , to the department an amount up to 25 twenty-five fifty thousand dollars for purposes of the fine 26 arts beginning teacher mentoring program established under 27 section 256.34 . 28 f. For the fiscal year beginning July 1, 2022 2023 , and 29 ending June 30, 2023 2024 , to the department an amount up 30 to six hundred twenty-six thousand one hundred ninety-one 31 dollars shall be used by the department for a delivery system, 32 in collaboration with area education agencies, to assist in 33 implementing the career paths and leadership roles considered 34 pursuant to sections 284.15 , 284.16 , and 284.17 , including but 35 -37- SF 560 (3) 90 jda/ns/mb 37/ 40
S.F. 560 not limited to planning grants to school districts and area 1 education agencies, technical assistance for the department, 2 technical assistance for districts and area education agencies, 3 training and staff development, and the contracting of external 4 expertise and services. In using moneys allocated for purposes 5 of this paragraph, the department shall give priority to school 6 districts with certified enrollments of fewer than six hundred 7 students. A portion of the moneys allocated annually to the 8 department for purposes of this paragraph may be used by the 9 department for administrative purposes and for not more than 10 five full-time equivalent positions. 11 g. For the fiscal year beginning July 1, 2023 2024 , and 12 for each subsequent fiscal year, to the department, ten 13 million dollars for purposes of implementing the supplemental 14 assistance for high-need schools provisions of section 284.11 . 15 Annually, of the moneys allocated to the department for 16 purposes of this paragraph, up to one hundred thousand dollars 17 may be used by the department for administrative purposes and 18 for not more than one full-time equivalent position. 19 DIVISION XV 20 EQUIPMENT REPLACEMENT AND PROGRAM-SHARING PROPERTY TAX LEVY 21 Sec. 38. Section 260C.28, subsection 2, Code 2023, is 22 amended to read as follows: 23 2. However, the board of directors may annually certify 24 for levy a tax on taxable property in the merged area at a 25 rate in excess of the three cents per thousand dollars of 26 assessed valuation specified under subsection 1 if the excess 27 tax levied does not cause the total rate certified to exceed a 28 rate of nine cents per thousand dollars of assessed valuation, 29 and the excess revenue generated is used for purposes of 30 program sharing between community colleges or for the purchase 31 of instructional equipment. Programs that are shared shall 32 be designed to increase student access to community college 33 programs and to achieve efficiencies in program delivery at the 34 community colleges, including , but not limited to , the programs 35 -38- SF 560 (3) 90 jda/ns/mb 38/ 40
S.F. 560 described under section 260C.46 . Prior to expenditure of the 1 excess revenues generated under this subsection , the board of 2 directors shall obtain the approval of the director of the 3 department of education. 4 Sec. 39. EFFECTIVE DATE. This division of this Act, being 5 deemed of immediate importance, takes effect upon enactment. 6 DIVISION XVI 7 ONLINE STATE JOB POSTING SYSTEM —— REPEAL 8 Sec. 40. Section 84A.6, Code 2023, is amended by adding the 9 following new subsection: 10 NEW SUBSECTION . 4. a. The department of workforce 11 development, in consultation with the department of education, 12 shall establish a system that allows the department of 13 education, school districts, charter schools, area education 14 agencies, and accredited nonpublic schools to post job openings 15 on an internet site. The system must include a mechanism for 16 the electronic submission of job openings for posting on the 17 internet site. The system and each job posting on the internet 18 site must include a statement that an employer submitting a job 19 opening for posting on the internet site will not discriminate 20 in hiring on the basis of race, ethnicity, national origin, 21 gender, age, physical disability, sexual orientation, gender 22 identity, religion, marital status, or status as a veteran. 23 b. The department of education, school districts, charter 24 schools, and area education agencies shall submit all job 25 openings to the department of workforce development for posting 26 on the internet site. An accredited nonpublic school may 27 submit job openings to the department of workforce development 28 for posting on the internet site. 29 c. This subsection shall not be construed to do any of the 30 following: 31 (1) Prohibit any employer from advertising job openings and 32 recruiting employees independently of the internet site. 33 (2) Prohibit any employer from using another method of 34 advertising job openings or another applicant tracking system 35 -39- SF 560 (3) 90 jda/ns/mb 39/ 40
