S.F. 301 Section 1. Section 123.45, subsection 3, Code 2023, is 1 amended to read as follows: 2 3. A person engaged in the wholesaling of beer or wine 3 may sell only disposable glassware, which is constructed of 4 paper, paper laminated, or plastic materials and designed 5 primarily for personal consumption on a one-time usage 6 basis, to retailers for use within the premises of licensed 7 establishments, for an amount which is greater than or equal 8 to an amount which represents the greater of either the amount 9 paid for the disposable glassware by the supplier or the amount 10 paid for the disposable glassware by the wholesaler. Also, 11 notwithstanding any other provision of this chapter or the fact 12 that a person is the holder of a class “A” beer permit, a native 13 brewery may be granted not more than two class “C” retail 14 alcohol licenses or not more than two special class “C” retail 15 alcohol licenses, both as defined in section 123.30 , regardless 16 of whether that person is also a manufacturer of native 17 distilled spirits pursuant to a class “A” native distilled 18 spirits license or a manufacturer of native wine pursuant to a 19 class “A” wine permit. 20 Sec. 2. Section 123.130, subsection 2, Code 2023, is amended 21 to read as follows: 22 2. Pursuant to section 123.45, subsection 3 , a native 23 brewery may be granted not more than two class “C” retail 24 alcohol licenses or not more than two special class “C” retail 25 alcohol licenses . 26 EXPLANATION 27 The inclusion of this explanation does not constitute agreement with 28 the explanation’s substance by the members of the general assembly. 29 This bill provides that a native brewery may be granted up 30 to two special class “C” retail alcohol licenses. Current law 31 provides that a native brewery may only be granted up to two 32 class “C” retail alcohol licenses. A special class “C” retail 33 alcohol license allows the holder to purchase and sell wine and 34 beer while a class “C” retail alcohol license authorizes the 35 -1- LSB 2235XS (2) 90 ec/rn 1/ 2
