  1 An Act relating to the dispensing of additional quantities of a
  2    prescription within the limitations of the prescription.

  1  1    Section 1.  Section 155A.27, Code 2016, is amended to read
  1  2 as follows:
  1  3    155A.27  Requirements for prescription.
  1  4    1.  To be valid, each prescription drug order issued
  1  5 or dispensed in this state must be based on a valid
  1  6 patient=practitioner relationship, and:
  1  7    1.  a.  If written, electronic, or facsimile, shall contain:
  1  8    a.  (1)  The date of issue.
  1  9    b.  (2)  The name and address of the patient for whom, or the
  1 10 owner of the animal for which, the drug is dispensed.
  1 11    c.  (3)  The name, strength, and quantity of the drug,
  1 12 medicine, or device prescribed.
  1 13    d.  (4)  The directions for use of the drug, medicine, or
  1 14 device prescribed.
  1 15    e.  (5)  The name, address, and written or electronic
  1 16 signature of the practitioner issuing the prescription.
  1 17    f.  (6)  The federal drug enforcement administration number,
  1 18 if required under chapter 124.
  1 19    2.  b.  If electronic:
  1 20    a.  (1)  The practitioner shall ensure that the electronic
  1 21 system used to transmit the electronic prescription has
  1 22 adequate security and system safeguards designed to prevent and
  1 23 detect unauthorized access, modification, or manipulation of
  1 24 the prescription.
  1 25    b.  (2)  The practitioner shall provide verbal verification
  1 26 of the electronic prescription upon the request of the
  1 27 pharmacy.
  1 28    3.  a.c.  (1)  If facsimile, in addition to the
  1 29 requirements of subsection 1 paragraph "a", shall contain all
  1 30 of the following:
  1 31    (1)  (a)  The identification number of the facsimile machine
  1 32 which is used to transmit the prescription.
  1 33    (2)  (b)  The time and date of transmission of the
  1 34 prescription.
  1 35    (3)  (c)  The name, address, telephone number, and facsimile
  2  1 number of the pharmacy to which the prescription is being
  2  2 transmitted.
  2  3    b.  (2)  A practitioner shall provide verbal verification of
  2  4 the facsimile prescription upon the request of the pharmacy.
  2  5    4.  d.  If oral, the practitioner issuing the prescription
  2  6 shall furnish the same information required for a written
  2  7 prescription, except for the written signature and address
  2  8 of the practitioner. Upon receipt of an oral prescription,
  2  9 the pharmacist shall promptly reduce the oral prescription to
  2 10 a written format by recording the information required in a
  2 11 written prescription.
  2 12    2.  This section shall not be interpreted to prohibit
  2 13 a pharmacist, in exercising the pharmacist's professional
  2 14 judgment, from dispensing, at one time, additional quantities
  2 15 of a prescription drug, with the exception of a prescription
  2 16 drug that is a controlled substance as defined in section
  2 17 124.101, up to the total number of dosage units authorized by
  2 18 the prescriber on the original prescription and any refills
  2 19 of the prescription, not to exceed a ninety=day supply of the
  2 20 prescription drug as specified in the prescription.
  2 21                           EXPLANATION
  2 22 The inclusion of this explanation does not constitute agreement with
  2 23 the explanation's substance by the members of the general assembly.
  2 24    This bill provides that the requirements for each
  2 25 prescription drug order issued or dispensed in the state are
  2 26 not to be interpreted to prohibit a pharmacist, in exercising
  2 27 the pharmacist's professional judgment, from dispensing, at
  2 28 one time, additional quantities of a prescription drug, with
  2 29 the exception of controlled substances, up to the total number
  2 30 of dosage units authorized by the prescriber on the original
  2 31 prescription and any refills of the prescription not to exceed
  2 32 a 90=day supply.
