H.F. _____ DIVISION I 1 MEDICAID EXTENDED POSTPARTUM COVERAGE 2 Section 1. MEDICAID EXTENDED POSTPARTUM COVERAGE 3 OPTION. The department of health and human services shall 4 submit a Medicaid state plan amendment to the centers for 5 Medicare and Medicaid services of the United States department 6 of health and human services for approval of the option 7 to provide twelve months of continuous postpartum coverage 8 under the Medicaid program to pregnant women enrolled in the 9 Medicaid program in accordance with sections 9812 and 9822 10 of the federal American Rescue Plan Act of 2021, Pub. L. No. 11 117-2, as amended by section 5113 of the federal Consolidated 12 Appropriations Act of 2023. 13 Sec. 2. EFFECTIVE DATE. This division of this Act, being 14 deemed of immediate importance, takes effect upon enactment. 15 DIVISION II 16 POSTPARTUM COVERAGE APPROPRIATION 17 Sec. 3. MEDICAID EXTENDED POSTPARTUM COVERAGE —— 18 APPROPRIATION. There is appropriated from the general fund of 19 the state to the department of human services for the following 20 fiscal years, the following amounts or so much thereof as is 21 necessary to fund extended postpartum coverage to pregnant 22 women enrolled in the Medicaid program in accordance with this 23 Act: 24 FY 2023-2024: 25 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 5,588,660 26 FY 2024-2025: 27 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 8,878,785 28 EXPLANATION 29 The inclusion of this explanation does not constitute agreement with 30 the explanation’s substance by the members of the general assembly. 31 DIVISION I —— MEDICAID EXTENDED POSTPARTUM COVERAGE. Under 32 current federal law, pregnant Medicaid beneficiaries are 33 eligible for at least pregnancy-related services through the 34 end of the month in which the 60-day period beginning on the 35 -1- LSB 2107YC (2) 90 pf/rh 1/ 2
H.F. _____ last day of the pregnancy ends. 1 Provisions of the federal American Rescue Plan Act of 2021 2 (H.R. 1319) provide the option to states to submit a state 3 plan amendment to provide postpartum Medicaid coverage for 12 4 months after the end of a pregnancy for a five-year period. A 5 provision under the federal Consolidated Appropriations Act of 6 2023 removed the five-year limitation. 7 This division of the bill requires the department of health 8 and human services (HHS) to submit a Medicaid state plan 9 amendment to the centers for Medicare and Medicaid services of 10 the United States department of health and human services for 11 approval of the new option to provide 12 months of continuous 12 postpartum coverage under the Medicaid program to pregnant 13 women enrolled in the Medicaid program. 14 The division of the bill takes effect upon enactment. 15 DIVISION II —— MEDICAID EXTENDED POSTPARTUM COVERAGE —— 16 APPROPRIATION. This division of the bill appropriates moneys 17 from the general fund of the state to HHS for FY 2023-2024 and 18 FY 2024-2025 for the state costs of postpartum coverage under 19 the Medicaid program. 20 -2- LSB 2107YC (2) 90 pf/rh 2/ 2
