Section
1.
NEW
SECTION
.
27B.1
Vaccine
information
on
1
identification
cards
——
prohibited.
2
The
state
or
any
political
subdivision
of
the
state
shall
3
not
include
on
an
identification
card
issued
by
the
state
or
4
political
subdivision
information
regarding
whether
the
holder
5
of
the
identification
card
has
received
a
vaccination
for
6
COVID-19,
as
defined
in
section
686D.2.

2.
NEW
SECTION
.
27B.2
Proof
of
vaccination
——
denial
8
of
state
grants
or
contracts.

1.
Notwithstanding
any
provision
of
law
to
the
contrary,
a
10
business
or
governmental
entity
shall
not
require
a
customer,
11
patron,
client,
patient,
or
other
person
who
is
invited
onto
12
the
premises
of
the
business
or
governmental
entity
to
furnish
13
proof
of
having
received
a
vaccination
for
COVID-19,
as
defined
14
in
section
686D.2,
prior
to
entering
onto
the
premises
of
15
the
business
or
governmental
entity.
This
section
does
not
16
prohibit
a
business
or
governmental
entity
from
implementing
17
a
COVID-19
screening
protocol
that
does
not
require
proof
of
18
vaccination
for
COVID-19.

2.
Notwithstanding
any
provision
of
law
to
the
contrary,
20
grants
or
contracts
funded
by
state
revenue
shall
not
21
be
awarded
to
or
renewed
with
respect
to
a
business
or
22
governmental
entity
that
violates
subsection
1
on
or
after
the
23
effective
date
of
this
Act.

For
the
purposes
of
this
section:
25
a.
“Business”
means
a
retailer
required
to
obtain
a
26
sales
tax
permit
pursuant
to
chapter
423,
a
nonprofit
or
27
not-for-profit
organization,
or
an
establishment
which
is
open
28
to
the
public
at
large
or
where
entrance
is
limited
by
a
cover
29
charge
or
membership
requirement,
but
does
not
include
a
health
30
care
facility
as
defined
in
section
686D.2.
31
b.
“Governmental
entity”
means
the
state
or
any
political
32
subdivision
of
the
state
that
owns,
leases,
or
operates
33
buildings
under
the
control
of
the
state
or
a
political
34
subdivision
of
the
state,
but
does
not
include
a
health
care

facility
as
defined
in
section

Sec.
3.
EFFECTIVE
DATE.
This
Act,
being
deemed
of
immediate
2
importance,
takes
effect
upon
enactment.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
5
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
proof
of
vaccination
for
COVID-19.
7
The
bill
prohibits
the
state
or
any
political
subdivision
of
8
the
state
from
including
on
an
identification
card
issued
9
by
the
state
or
political
subdivision
information
regarding
10
whether
the
holder
of
the
identification
card
has
received
a
11
vaccination
for
COVID-19.
12
The
bill
also
prohibits
a
business
or
governmental
entity,
13
defined
in
the
bill,
from
requiring
a
customer,
patron,
client,
14
patient,
or
other
person
who
is
invited
onto
the
premises
to
15
furnish
proof
of
having
received
a
vaccination
for
COVID-19
16
prior
to
entering
a
premises
of
a
business
or
governmental
17
entity.
The
bill
makes
any
business
or
governmental
entity
18
that
requires
such
proof
ineligible
to
receive
grants
and
19
contracts
funded
by
state
revenue.
The
bill
does
not
prohibit
20
a
business
or
governmental
entity
from
implementing
a
COVID-19
21
screening
protocol
that
does
not
require
proof
of
vaccination
22
for
COVID-19.
23
The
bill
takes
effect
upon
enactment.
