H.F. 680 Section 1. Section 321M.9, subsection 1, paragraph a, Code 1 2023, is amended by adding the following new subparagraph: 2 NEW SUBPARAGRAPH . (4) The ten-dollar convenience fee 3 collected pursuant to subsection 1A. 4 Sec. 2. Section 321M.9, Code 2023, is amended by adding the 5 following new subsection: 6 NEW SUBSECTION . 1A. Convenience fee. A county authorized 7 to issue driver’s licenses under this chapter may charge, in 8 addition to any other fee imposed by law, a convenience fee for 9 the issuance or renewal of a driver’s license or nonoperator’s 10 identification card to a person who is not a resident of the 11 county, unless that person pays property tax to the county 12 and provides proof of payment such as a receipt as provided 13 in section 445.5, subsection 6, or another form of proof as 14 determined by the county. The convenience fee shall be ten 15 dollars. 16 EXPLANATION 17 The inclusion of this explanation does not constitute agreement with 18 the explanation’s substance by the members of the general assembly. 19 Current law authorizes certain counties to issue driver’s 20 licenses and nonoperator’s identification cards if the county 21 meets standards set by the department of transportation. A 22 county retains for deposit in the county general fund $7 of 23 fees received for each issuance or renewal of driver’s licenses 24 and nonoperator’s identification cards. This bill allows a 25 county authorized to issue driver’s licenses to charge a $10 26 convenience fee for the issuance or renewal of a driver’s 27 license or nonoperator’s identification card to a person who 28 is not a resident of the county. However, the county cannot 29 charge the convenience fee to a nonresident person who pays 30 property tax to the county if the person provides proof that 31 they paid property tax, such as a receipt from the county 32 treasurer or another form of proof as determined by the county. 33 The county treasurer retains the entire convenience fee 34 collected for deposit in the county general fund. 35 -1- LSB 1789HZ (2) 90 th/ns 1/ 1
