H.F. 2453 Section 1. Section 216.6A, subsection 2, Code 2022, is 1 amended by adding the following new paragraph: 2 NEW PARAGRAPH . 0b. It shall be an unfair or discriminatory 3 practice for any employer or agent of any employer to inquire 4 about a prospective employee’s wage or salary history before an 5 offer of employment with compensation has been negotiated and 6 made to the prospective employee, unless a prospective employee 7 has voluntarily disclosed such information. 8 Sec. 2. Section 216.6A, Code 2022, is amended by adding the 9 following new subsection: 10 NEW SUBSECTION . 3A. In an action alleging wage 11 discrimination under this section, an employer shall not use an 12 employee’s prior wage and salary history as a defense to such 13 action. 14 EXPLANATION 15 The inclusion of this explanation does not constitute agreement with 16 the explanation’s substance by the members of the general assembly. 17 This bill provides that it shall be an unfair or 18 discriminatory practice relating to wage discrimination 19 under Code chapter 216 for any employer to inquire about a 20 prospective employee’s wage or salary history before an offer 21 of employment with compensation has been made.
