  3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 232.116, subsection 1, Code 2016, is
  1  2 amended by adding the following new paragraph:
  1  3    NEW PARAGRAPH.  p.  The court finds there is clear and
  1  4 convincing evidence that the child was conceived as the result
  1  5 of sexual abuse as defined in section 709.1, and the biological
  1  6 parent against whom the sexual abuse was perpetrated requests
  1  7 termination of the parental rights of the biological parent who
  1  8 perpetrated the sexual abuse.
  1  9    Sec. 2.  Section 600A.8, Code 2016, is amended by adding the
  1 10 following new subsection:
  1 11    NEW SUBSECTION.  11.  The court finds there is clear and
  1 12 convincing evidence that the child was conceived as the result
  1 13 of sexual abuse as defined in section 709.1, and the biological
  1 14 parent against whom the sexual abuse was perpetrated requests
  1 15 termination of the parental rights of the biological parent who
  1 16 perpetrated the sexual abuse.
