  1 An Act relating to the medical cannabidiol Act, by amending
  2    the definition of medical cannabidiol and altering the
  3    composition and duties of the medical cannabidiol board.
  4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 124E.2, subsection 6, Code 2018, is
  1  2 amended by striking the subsection and inserting in lieu
  1  3 thereof the following:
  1  4    6.  "Medical cannabidiol" means any species of the genus
  1  5 cannabis plant, or any mixture or preparation of them,
  1  6 including whole plant extracts and resins.
  1  7    Sec. 2.  Section 124E.5, subsection 1, paragraph a, Code
  1  8 2018, is amended to read as follows:
  1  9    a.  A medical cannabidiol board is created consisting of
  1 10 eight practitioners representing the fields of neurology, pain
  1 11 management, gastroenterology, oncology, psychiatry, pediatrics,
  1 12 family medicine, and pharmacy, and one representative from law
  1 13 enforcement, and a patient or primary caregiver in possession
  1 14 of a valid medical cannabidiol registration card issued
  1 15 pursuant to this chapter.
  1 16    Sec. 3.  Section 124E.5, subsection 2, Code 2018, is amended
  1 17 to read as follows:
  1 18    2.  The medical cannabidiol board shall convene at least
  1 19 twice but no more than four times per year.
  1 20    Sec. 4.  Section 124E.5, subsection 3, Code 2018, is amended
  1 21 by adding the following new paragraph:
  1 22    NEW PARAGRAPH.  f.  Adding by rule medical conditions,
  1 23 medical treatments, or debilitating diseases to the list of
  1 24 debilitating medical conditions for which the medical use of
  1 25 cannabidiol would be medically beneficial under this chapter if
  1 26 the medical use of cannabidiol is approved for the treatment of
  1 27 such a medical condition, medical treatment, or debilitating
  1 28 disease in at least two neighboring states.
  1 29                           EXPLANATION
  1 30 The inclusion of this explanation does not constitute agreement with
  1 31 the explanation's substance by the members of the general assembly.
  1 32    This bill relates to the medical cannabidiol Act.
  1 33    The bill alters the definition of medical cannabidiol
  1 34 by providing that "medical cannabidiol" means any species
  1 35 of the genus cannabis plant, or any mixture or preparation
  2  1 thereof, including whole plant extracts and resins. The bill
  2  2 removes the requirement in the current definition that medical
  2  3 cannabidiol have a tetrahydrocannabinol (THC) level of no more
  2  4 than 3 percent. The bill adds to the members of the medical
  2  5 cannabidiol board a patient or primary caregiver with a valid
  2  6 medical cannabidiol registration card issued under Code chapter
  2  7 124E (medical cannabidiol Act), and removes the requirement
  2  8 that the medical cannabidiol board meet no more than four times
  2  9 per year.
  2 10    The bill allows the medical cannabidiol board to add to the
  2 11 list of debilitating medical conditions for which a medical
  2 12 cannabidiol registration card may be issued if the treatment by
  2 13 medical cannabidiol of such a debilitating medical condition is
  2 14 approved by at least two neighboring states.
