H.F. 2319 DIVISION I 1 LEGISLATIVE SERVICES AGENCY —— ELIMINATION 2 Section 1. Section 2.12, subsection 4, Code 2022, is amended 3 to read as follows: 4 4. There is appropriated out of any funds in the state 5 treasury not otherwise appropriated such sums as may be 6 necessary for the fiscal year budgets budget of the legislative 7 services agency and the office of ombudsman for salaries, 8 support, maintenance, and miscellaneous purposes to carry 9 out their its statutory responsibilities. The legislative 10 services agency and the office of ombudsman shall submit their 11 its proposed budgets budget to the legislative council not 12 later than September 1 of each year. The legislative council 13 shall review and approve the proposed budgets budget not later 14 than December 1 of each year. The budget approved by the 15 legislative council for each of its statutory legislative 16 agencies shall be transmitted by the legislative council 17 to the department of management on or before December 1 18 of each year for the fiscal year beginning July 1 of the 19 following year. The department of management shall submit 20 the approved budgets received from the legislative council 21 to the governor for inclusion in the governor’s proposed 22 budget for the succeeding fiscal year. The approved budgets 23 shall also be submitted to the chairpersons of the committees 24 on appropriations. The committees on appropriations may 25 allocate from the funds appropriated by this section the funds 26 contained in the approved budgets, or such other amounts as 27 specified, pursuant to a concurrent resolution to be approved 28 by both houses of the general assembly. The director of the 29 department of administrative services shall issue warrants for 30 salaries, support, maintenance, and miscellaneous purposes 31 upon requisition by the administrative head of each statutory 32 legislative agency. If the legislative council elects to 33 change the approved budget for a legislative agency prior to 34 July 1, the legislative council shall transmit the amount of 35 -1- LSB 6033YH (5) 89 ss/rn 1/ 21
H.F. 2319 the budget revision to the department of management prior to 1 July 1 of the fiscal year, however, if the general assembly 2 approved the budget it cannot be changed except pursuant to a 3 concurrent resolution approved by the general assembly. 4 Sec. 2. Section 2.42, subsections 1, 2, and 14, Code 2022, 5 are amended by striking the subsections. 6 Sec. 3. Section 2.46, subsection 2, Code 2022, is amended 7 to read as follows: 8 2. Examination. Examine the reports and official acts of 9 the executive council and of each officer, board, commission, 10 and department of the state, in respect to the conduct and 11 expenditures thereof and the receipts and disbursements of 12 public funds thereby. All state departments and agencies are 13 required to immediately notify the legislative fiscal committee 14 of the legislative council and the director of the legislative 15 services agency if any state facilities within their 16 jurisdiction have been cited for violations of any federal, 17 state, or local laws or regulations or have been decertified 18 or notified of the threat of decertification from compliance 19 with any state, federal, or other nationally recognized 20 certification or accreditation agency or organization. 21 Sec. 4. Section 2.48, subsection 2, paragraph b, 22 subparagraph (1), Code 2022, is amended to read as follows: 23 (1) Estimate for each fiscal year, in conjunction with the 24 legislative services agency and the department of revenue, the 25 cost of each individual tax expenditure and the total cost 26 of all tax expenditures, and by December 15 provide those 27 estimates to the governor for use in the preparation of the 28 budget message under section 8.22 and to the general assembly 29 to be used in the budget process. 30 Sec. 5. Section 2.69, subsection 6, Code 2022, is amended by 31 striking the subsection. 32 Sec. 6. Section 2B.5, subsection 3, Code 2022, is amended 33 to read as follows: 34 3. H.F. 2319 legislative services agency, the legislative council , or the 1 administrative rules review committee and as provided by law. 2 Sec. 7. Section 2B.6, subsection 3, Code 2022, is amended 3 to read as follows: 4 3. Perform other duties as directed by the director of the 5 legislative services agency or the legislative council and as 6 provided by law. 7 Sec. 8. Section 7D.29, subsection 2, paragraph a, Code 2022, 8 is amended by striking the paragraph. 9 Sec. 9. Section 8.55, subsection 3, paragraph c, 10 subparagraph (2), Code 2022, is amended to read as follows: 11 (2) The governor issues an official proclamation and 12 notifies the legislative fiscal committee and the legislative 13 services agency that the balance of the general fund is 14 negative and that an appropriation made pursuant to this 15 paragraph brings the general fund of the state into balance. 16 Sec. 10. Section 8.62, subsection 3, Code 2022, is amended 17 to read as follows: 18 3. On or before June 30 of the fiscal year following the 19 fiscal year in which funds were encumbered under this section , 20 an agency encumbering funds under this section shall report 21 to the joint appropriations subcommittee which recommends 22 funding for the agency, the legislative services agency, the 23 department of management, and the legislative fiscal committee 24 of the legislative council detailing how the moneys were 25 expended. Moneys shall not be encumbered under this section 26 from an appropriation which received a transfer from another 27 appropriation pursuant to section 8.39 . 28 Sec. 11. Section 8A.123, subsection 1, Code 2022, is amended 29 to read as follows: 30 1. Activities of the department shall be accounted 31 for within the general fund of the state, except that the 32 director may establish and maintain internal service funds 33 in accordance with generally accepted accounting principles, 34 as defined in section 8.57, subsection 4 , for activities of 35 -3- LSB 6033YH (5) 89 ss/rn 3/ 21
H.F. 2319 the department which are primarily funded from billings to 1 governmental entities for services rendered by the department. 2 The establishment of an internal service fund is subject to 3 the approval of the director of the department of management 4 and the concurrence of the auditor of state. At least ninety 5 days prior to the establishment of an internal service fund 6 pursuant to this section , the director shall notify in writing 7 the general assembly, including the legislative council , and 8 the legislative fiscal committee , and the legislative services 9 agency . 10 Sec. 12. Section 8A.124, Code 2022, is amended to read as 11 follows: 12 8A.124 Additional personnel. 13 The department may employ, upon the approval of the 14 department of management, additional personnel in excess of 15 the number of full-time equivalent positions authorized by the 16 general assembly if such additional personnel are reasonable 17 and necessary to perform such duties as required to meet 18 the needs of the department to provide services to other 19 governmental entities and as authorized by this chapter . The 20 director shall notify in writing the department of management , 21 and the legislative fiscal committee , and the legislative 22 services agency of any additional personnel employed pursuant 23 to this section . 24 Sec. 13. Section 8A.321, subsection 16, unnumbered 25 paragraph 1, Code 2022, is amended to read as follows: 26 At least thirty days prior to entering into a contract 27 for a lease or renewal of a lease pursuant to subsection 6 28 or a contract for the acquisition of real property pursuant 29 to subsection 9 in which any part or the total amount of 30 the contract is at least fifty thousand dollars, notify the 31 legislative services agency concerning the contract. The 32 legislative services agency shall submit the notification 33 to the general assembly’s standing committees on government 34 oversight. The notification is required regardless of 35 -4- LSB 6033YH (5) 89 ss/rn 4/ 21
H.F. 2319 the source of payment for the lease, renewal of lease, or 1 acquisition of real property. The notification shall include 2 all of the following information: 3 Sec. 14. Section 8A.341, subsection 2, Code 2022, is amended 4 to read as follows: 5 2. If money is appropriated for this purpose, by November 1 6 of each year supply a report which contains the name, gender, 7 county, or city of residence when possible, official title, 8 salary received during the previous fiscal year, base salary as 9 computed on July 1 of the current fiscal year, and traveling 10 and subsistence expense of the personnel of each of the 11 departments, boards, and commissions of the state government 12 except personnel who receive an annual salary of less than one 13 thousand dollars. The number of the personnel and the total 14 amount received by them shall be shown for each department in 15 the report. All employees who have drawn salaries, fees, or 16 expense allowances from more than one department or subdivision 17 shall be listed separately under the proper departmental 18 heading. On the request of the director, the head of each 19 department, board, or commission shall furnish the data 20 covering that agency. The report shall be distributed upon 21 request without charge in an electronic medium to each caucus 22 of the general assembly, the legislative services agency, the 23 chief clerk of the house of representatives, and the secretary 24 of the senate. Copies of the report shall be made available to 25 other persons in an electronic medium upon payment of a fee, 26 which shall not exceed the cost of providing the copy of the 27 report. Sections 22.2 through 22.5 apply to the report. All 28 funds from the sale of the report shall be deposited in the 29 printing revolving fund established in section 8A.345 . 30 Sec. 15. Section 8B.13, subsections 1 and 5, Code 2022, are 31 amended to read as follows: 32 1. Activities of the office shall be accounted for 33 within the general fund of the state, except that the chief 34 information officer may establish and maintain internal 35 -5- LSB 6033YH (5) 89 ss/rn 5/ 21
H.F. 2319 service funds in accordance with generally accepted accounting 1 principles, as defined in section 8.57, subsection 4 , for 2 activities of the office which are primarily funded from 3 billings to governmental entities for services rendered by 4 the office. The establishment of an internal service fund is 5 subject to the approval of the director of the department of 6 management and the concurrence of the auditor of state. At 7 least ninety days prior to the establishment of an internal 8 service fund pursuant to this section , the chief information 9 officer shall notify in writing the general assembly, including 10 the legislative council , and the legislative fiscal committee , 11 and the legislative services agency . 12 5. The office shall submit an annual report not later 13 than October 1 to the members of the general assembly and the 14 legislative services agency of the activities funded by and 15 expenditures made from an internal service fund established 16 pursuant to this section during the preceding fiscal year. 17 Sec. 16. Section 8B.33, subsection 2, Code 2022, is amended 18 to read as follows: 19 2. The office shall submit an annual report not later than 20 January 31 to the members of the general assembly and the 21 legislative services agency of the activities funded by and 22 expenditures made from the revolving fund during the preceding 23 fiscal year. Section 8.33 does not apply to any moneys in the 24 revolving fund, and, notwithstanding section 12C.7, subsection 25 2 , earnings or interest on moneys deposited in the revolving 26 fund shall be credited to the revolving fund. 27 Sec. 17. Section 8E.209, Code 2022, is amended to read as 28 follows: 29 8E.209 Periodic performance audits and performance data 30 validation. 31 1. The department, in consultation with the legislative 32 services agency, the auditor of state , and agencies, shall 33 establish and implement a system of periodic performance 34 audits. The purpose of a performance audit is to assess the 35 -6- LSB 6033YH (5) 89 ss/rn 6/ 21
H.F. 2319 performance of an agency in carrying out its programs in light 1 of the agency strategic plan, including the effectiveness 2 of its programs, based on performance measures, performance 3 targets, and performance data. The department may make 4 recommendations to improve agency performance which may include 5 modifying, streamlining, consolidating, expanding, redesigning, 6 or eliminating programs. 7 2. The department, in cooperation with the legislative 8 services agency and the auditor of state, shall provide for the 9 analysis of the integrity and validity of performance data. 10 Sec. 18. Section 8G.3, subsection 7, Code 2022, is amended 11 to read as follows: 12 7. “State audit or report” shall include any audit or report 13 issued by the auditor of state, department of management, 14 legislative services agency, legislative committee, or 15 executive body relating to the entity or recipient of state 16 funds, the budget program or activity, or agency. 17 Sec. 19. Section 13.2, subsection 1, paragraph o, Code 2022, 18 is amended to read as follows: 19 o. Submit a report by January 15 of each year to the 20 co-chairpersons and ranking members of the joint appropriations 21 subcommittee on the justice system , and to the executive 22 council , and to the legislative services agency detailing the 23 amount of annual money receipts generated by each settlement 24 or judgment in excess of two hundred fifty thousand dollars 25 collected pursuant to legal proceedings under chapters 455B , 26 553 , and 714 . The report shall include the name of the civil 27 or criminal case involved, the court of jurisdiction, the 28 settlement amount, the state’s share of the settlement amount, 29 the name of the fund in which the receipts were deposited, and 30 the planned use of the moneys. 31 Sec. 20. Section 13.32, subsection 1, paragraph b, Code 32 2022, is amended to read as follows: 33 b. The report shall be provided to the co-chairpersons and 34 ranking members of the joint appropriations subcommittee on the 35 -7- LSB 6033YH (5) 89 ss/rn 7/ 21
H.F. 2319 justice system , and the governor , and the legislative services 1 agency by January 15, 2015, and each January 15 thereafter. 2 Sec. 21. Section 13B.4, subsection 7, Code 2022, is amended 3 to read as follows: 4 7. The state public defender shall not revise the 5 allocations to the office of the state public defender 6 and the allocations for indigent defense of adults and 7 juveniles, unless prior notice of the revisions is given to the 8 legislative services agency, the co-chairpersons and ranking 9 members of the joint appropriations subcommittee on the justice 10 system , and the co-chairpersons and ranking members of the 11 house and senate committees on appropriations. 12 Sec. 22. Section 15.120, subsection 3, paragraph b, Code 13 2022, is amended to read as follows: 14 b. The center shall prepare an annual report in coordination 15 with the authority. The center shall submit the report to the 16 general assembly and the legislative services agency by January 17 15 of each year. 18 Sec. 23. Section 28B.4, subsection 2, Code 2022, is amended 19 to read as follows: 20 2. The commission’s members and the members of all 21 committees which it establishes shall be reimbursed for 22 their travel and other necessary expenses in carrying out 23 their obligations under this chapter and legislative members 24 shall be paid a per diem for each day in which engaged in the 25 performance of their duties, the per diem and legislators’ 26 expenses to be paid from funds appropriated by sections 27 2.10 and 2.12 . Expenses of administrative officers, state 28 officials, or state employees who are members of the Iowa 29 commission on interstate cooperation or a committee appointed 30 by the commission shall be paid from funds appropriated to 31 the agencies or departments which persons represent except as 32 may otherwise be provided by the general assembly. Expenses 33 of citizen members who may be appointed to committees of 34 the commission may be paid from funds as authorized by the 35 -8- LSB 6033YH (5) 89 ss/rn 8/ 21

Expenses of the secretary or employees 1 of the secretary and support services in connection with 2 the administration of the commission shall be paid from 3 funds appropriated to the legislative services agency unless 4 otherwise provided designated by the general assembly. 5 Expenses of commission members shall be paid upon approval of 6 the chairperson or the secretary of the commission. 7 Sec. 24. Section 80.48, subsection 3, unnumbered paragraph 8 1, Code 2022, is amended to read as follows: 9 The department shall submit a report to the co-chairpersons 10 and ranking members of the joint appropriations subcommittee on 11 the justice system and to the legislative services agency on or 12 before December 31 of each year which shall contain all of the 13 following: 14 Sec. 25. Section 80E.1, subsection 2, paragraph c, Code 15 2022, is amended to read as follows: 16 c. Submit an advisory budget recommendation to the governor 17 and general assembly concerning enforcement programs, treatment 18 programs, and education programs related to drugs within the 19 various departments. The coordinator shall work with these 20 departments in developing the departmental budget requests to 21 be submitted to the legislative services agency and the general 22 assembly. 23 Sec. 26. Section 97B.17, subsection 5, Code 2022, is amended 24 to read as follows: 25 5. Confidential records of the system maintained for 26 the operation of the retirement system may be released to 27 the directors, agents, and employees of the legislative 28 services agency, the department of revenue, the department 29 of management, the department of administrative services, or 30 an employer of employees covered by the retirement system 31 pursuant to rules adopted by the system for the performance 32 of the requestor’s duties. To obtain a record under this 33 subsection , the person requesting the records shall provide 34 a written description of the information requested and the 35 -9- LSB 6033YH (5) 89 ss/rn 9/ 21
H.F. 2319 reason for requesting the records to the system. A person 1 receiving a record pursuant to this subsection shall maintain 2 the confidentiality of any information otherwise required to be 3 kept confidential and shall be subject to the same penalties as 4 the custodian of the records for the public dissemination of 5 such information. 6 Sec. 27. Section 99D.14, subsection 2, paragraphs e and f, 7 Code 2022, are amended to read as follows: 8 e. By January 1, 2015, and by January 1 of every year 9 thereafter, the division of criminal investigation shall 10 provide the co-chairpersons and ranking members of the 11 joint appropriations subcommittee on the justice system , the 12 legislative services agency, and the commission with a report 13 detailing the activities of the division during the previous 14 fiscal year for each racetrack enclosure. 15 f. The division of criminal investigation shall conduct 16 a review relating to the number of special agents permitted 17 for each racetrack under this subsection and the activities 18 of such agents. The review shall also include comments from 19 the commission and licensees and be combined with the review 20 conducted under section 99F.10, subsection 4 , paragraph “g” . 21 The division of criminal investigation shall file a report 22 detailing the review conducted pursuant to this paragraph 23 with the co-chairpersons and ranking members of the joint 24 appropriations subcommittee on the justice system and the 25 legislative services agency by July 1, 2020. 26 Sec. 28. Section 99F.10, subsection 4, paragraphs f and g, 27 Code 2022, are amended to read as follows: 28 f. By January 1, 2015, and by January 1 of every year 29 thereafter, the division of criminal investigation shall 30 provide the co-chairpersons and ranking members of the 31 joint appropriations subcommittee on the justice system , the 32 legislative services agency, and the commission with a report 33 detailing the activities of the division during the previous 34 fiscal year for each excursion gambling boat and gambling 35 -10- LSB 6033YH (5) 89 ss/rn 10/ 21
H.F. 2319 structure. 1 g. The division of criminal investigation shall review 2 the number of special agents permitted for each excursion 3 gambling boat or gambling structure under this subsection and 4 the activities of such agents. The review shall also include 5 comments from the commission and licensees and be combined 6 with the review conducted under section 99D.14, subsection 2 , 7 paragraph “f” . The division of criminal investigation shall 8 file a report detailing the review conducted pursuant to this 9 paragraph with the co-chairpersons and ranking members of the 10 joint appropriations subcommittee on the justice system and the 11 legislative services agency by July 1, 2020. 12 Sec. 29. Section 99G.40, subsection 4, Code 2022, is amended 13 to read as follows: 14 4. For informational purposes only, the chief executive 15 officer shall submit to the department of management by October 16 1 of each year a proposed operating budget for the authority 17 for the succeeding fiscal year. This budget proposal shall 18 also be accompanied by an estimate of the net proceeds to 19 be deposited into the general fund during the succeeding 20 fiscal year. This budget shall be on forms prescribed by the 21 department of management. A copy of the information required 22 to be submitted to the department of management pursuant to 23 this subsection shall be submitted to the general assembly’s 24 standing committees on government oversight and the legislative 25 services agency by October 1 of each year. 26 Sec. 30. Section 135D.6, subsection 3, paragraph f, Code 27 2022, is amended to read as follows: 28 f. Provide an annual budget and fiscal report for the Iowa 29 health information network to the governor, the department of 30 public health, the department of management, and the chairs 31 and ranking members of the legislative government oversight 32 standing committees , and the legislative services agency . 33 The report shall also include information about the services 34 provided through the network and information on the participant 35 -11- LSB 6033YH (5) 89 ss/rn 11/ 21
H.F. 2319 usage of the network. 1 Sec. 31. Section 237.18, subsection 6, Code 2022, is amended 2 to read as follows: 3 6. In conjunction with the legislative services agency 4 and in In consultation with the department of human services, 5 supreme court, and private foster care providers, develop and 6 maintain an evaluation program regarding citizen foster care 7 review programming. The evaluation program shall be designed 8 to evaluate the effectiveness of citizen reviews in improving 9 case permanency planning and meeting case permanency planning 10 goals, identify the amount of time children spend in foster 11 care placements, and identify problem issues in the foster care 12 system. The state board shall submit an annual evaluation 13 report to the governor and the general assembly. 14 Sec. 32. Section 256E.7, subsection 2, paragraph f, Code 15 2022, is amended to read as follows: 16 f. Be subject to the same financial audits, audit 17 procedures, and audit requirements as a school district. The 18 audit shall be consistent with the requirements of sections 19 11.6 , 11.14 , 11.19 , and 279.29 , and section 256.9, subsection 20 20 , except to the extent deviations are necessary because of 21 the program at the school. The department , or the auditor 22 of state , or the legislative services agency may conduct 23 financial, program, or compliance audits. 24 Sec. 33. Section 256F.4, subsection 2, paragraph f, Code 25 2022, is amended to read as follows: 26 f. Be subject to the same financial audits, audit 27 procedures, and audit requirements as a school district. The 28 audit shall be consistent with the requirements of sections 29 11.6 , 11.14 , 11.19 , 256.9, subsection 20 , and section 279.29 , 30 except to the extent deviations are necessary because of 31 the program at the school. The department , or the auditor 32 of state , or the legislative services agency may conduct 33 financial, program, or compliance audits. 34 Sec. 34. Section 260C.66, subsection 1, unnumbered 35 -12- LSB 6033YH (5) 89 ss/rn 12/ 21
H.F. 2319 paragraph 1, Code 2022, is amended to read as follows: 1 The board of directors of each community college shall 2 determine , in consultation with the legislative services 3 agency, the financial information to be included in line item 4 budget information for projects funded by the issuance of 5 bonds or notes under this chapter and shall submit the line 6 item budget information to the general assembly as requested. 7 The board of directors of each community college shall submit 8 quarterly reports to the general assembly concerning the 9 projects funded by the issuance of bonds or notes under this 10 chapter as follows: 11 Sec. 35. Section 261.2, subsection 11, Code 2022, is amended 12 to read as follows: 13 11. Require any postsecondary institution whose students 14 are eligible for or who receive financial assistance under 15 programs administered by the commission to transmit annually 16 to the commission information about the numbers of minority 17 students enrolled in and minority faculty members employed 18 at the institution. The commission shall compile and report 19 the information collected to the general assembly , and the 20 governor , and the legislative services agency by March 1 21 annually. 22 Sec. 36. Section 262A.13, subsection 1, unnumbered 23 paragraph 1, Code 2022, is amended to read as follows: 24 The state board of regents shall determine , in consultation 25 with the legislative services agency, the financial information 26 to be included in line item budget information for projects 27 funded by the issuance of bonds or notes under this chapter and 28 shall submit the line item budget information to the general 29 assembly as requested. The state board of regents shall submit 30 quarterly reports to the general assembly concerning the 31 projects funded by the issuance of bonds or notes under this 32 chapter as follows: 33 Sec. 37. Section 272.10, subsection 4, Code 2022, is amended 34 to read as follows: 35 -13- LSB 6033YH (5) 89 ss/rn 13/ 21
H.F. 2319 4. The board shall submit a detailed annual financial 1 report by January 1 to the general assembly and the legislative 2 services agency . 3 Sec. 38. Section 292.2, subsection 1, paragraph c, Code 4 2022, is amended to read as follows: 5 c. The department of education, in consultation with 6 the department of revenue and the legislative services 7 agency , shall annually calculate the estimated tax for school 8 infrastructure that is or would be received by each school 9 district in the state pursuant to section 423F.2 . These 10 calculations shall be made on a total tax and on a tax per pupil 11 basis for each school district. 12 Sec. 39. Section 307.20, subsection 1, Code 2022, is amended 13 to read as follows: 14 1. A biodiesel and biodiesel blended fuel revolving fund 15 is created in the state treasury. The biodiesel and biodiesel 16 blended fuel revolving fund shall be administered by the 17 department and shall consist of moneys received from the sale 18 of EPAct credits banked by the department on April 19, 2001, 19 moneys appropriated by the general assembly, and any other 20 moneys obtained or accepted by the department for deposit in 21 the fund. Moneys in the fund are appropriated to and shall 22 be used by the department for the purchase of biodiesel and 23 biodiesel blended fuel for use in department vehicles. The 24 department shall submit an annual report not later than January 25 31 to the members of the general assembly and the legislative 26 services agency, of the expenditures made from the fund during 27 the preceding fiscal year. Section 8.33 does not apply to 28 any moneys in the fund and, notwithstanding section 12C.7, 29 subsection 2 , earnings or interest on moneys deposited in the 30 fund shall be credited to the fund. 31 Sec. 40. Section 307.32, Code 2022, is amended to read as 32 follows: 33 307.32 Annual report —— secondary road construction program 34 —— structurally deficient bridges. 35 -14- LSB 6033YH (5) 89 ss/rn 14/ 21
H.F. 2319 On or before February 15 of each year, the department, in 1 collaboration with the Iowa county engineers association, shall 2 compile the annual reports received from counties pursuant to 3 sections 309.22 and 309.22A into a cumulative report and submit 4 the cumulative report in electronic format to the chairpersons 5 of the senate and house of representatives standing committees 6 on transportation and the legislative services agency . 7 Sec. 41. Section 307.46, subsection 2, Code 2022, is amended 8 to read as follows: 9 2. On or before June 30 of the fiscal year following the 10 fiscal year in which funds were encumbered under this section , 11 the department shall report to the joint transportation, 12 infrastructure, and capitals appropriations subcommittee, the 13 legislative services agency, the department of management, the 14 general assembly’s standing committees on government oversight, 15 and the legislative fiscal committee of the legislative council 16 detailing how the moneys were expended. Moneys shall not be 17 encumbered under this section from an appropriation which 18 received a transfer from another appropriation pursuant to 19 section 8.39 . 20 Sec. 42. Section 331.391, subsection 2, Code 2022, is 21 amended to read as follows: 22 2. The accounting system and financial reporting to the 23 department shall conform with the cost principles for state, 24 local, and Indian tribal governments issued by the United 25 States office of management and budget. The information 26 shall segregate expenditures for administration, purchase of 27 service, and enterprise costs for which the region is a service 28 provider or is directly billing and collecting payments and 29 shall be identified along with other financial information in 30 a uniform chart of accounts prescribed by the department of 31 management. Following periodic review of administrative costs, 32 the department shall make recommendations , in consultation 33 with the legislative services agency, for standards defining 34 region administrative costs and the methodology for calculating 35 -15- LSB 6033YH (5) 89 ss/rn 15/ 21
H.F. 2319 a region’s administrative load. Such standards shall be 1 specified in rule adopted by the state commission. 2 Sec. 43. Section 331.403, subsection 3, paragraph a, Code 3 2022, is amended to read as follows: 4 a. Each county that had an urban renewal plan and area in 5 effect at any time during the most recently ended fiscal year 6 shall complete for each such urban renewal plan and area and 7 file with the department of management an urban renewal report 8 by December 1 following the end of such fiscal year. Each 9 report shall be approved by the affirmative vote of a majority 10 of the board and be prepared in the format and submitted 11 electronically pursuant to the instructions prescribed by the 12 department of management in consultation with the legislative 13 services agency . 14 Sec. 44. Section 331.655, subsection 5, Code 2022, is 15 amended to read as follows: 16 5. The Iowa state sheriffs’ and deputies’ association 17 shall, no later than December 1, 2016, and every six years 18 thereafter, submit to the chairpersons and ranking members 19 of the standing committees on ways and means and to the 20 legislative services agency a report that details, based on at 21 least one year’s data from a random sampling of at least ten 22 rural counties and at least six urban counties as determined by 23 the association, the total annual county budget allocation to 24 the sheriff to fulfill those duties for which the sheriff is 25 required to collect a fee under subsection 1 , the average cost 26 per service, summons, execution, or other activity by activity 27 category, the revenue generated by collection of those fees 28 by category, and the associated impact on property taxes for 29 each county to fulfill those duties for which the sheriff is 30 required to collect a fee under subsection 1 . The standing 31 committees on ways and means shall review the report during 32 the next succeeding legislative session and the committees may 33 sponsor and submit legislative bills for consideration by the 34 general assembly to adjust the fees collected by the sheriff 35 -16- LSB 6033YH (5) 89 ss/rn 16/ 21
H.F. 2319 pursuant to subsection 1 . For the purposes of this subsection , 1 the term “category” means each separate activity for which the 2 sheriff is required to collect a fee under subsection 1 . 3 Sec. 45. Section 357H.9, subsection 2, paragraph a, Code 4 2022, is amended to read as follows: 5 a. Each board of trustees that has by resolution provided 6 for a division of taxes in the rural improvement zone during 7 the most recently ended fiscal year shall complete and file 8 with the department of management a tax increment financing 9 report by December 1 following the end of such fiscal year. 10 The report shall be approved by the affirmative vote of a 11 majority of the board of trustees and be prepared in the format 12 and submitted electronically pursuant to the instructions 13 prescribed by the department of management in consultation with 14 the legislative services agency . 15 Sec. 46. Section 384.22, subsection 2, paragraphs a and c, 16 Code 2022, are amended to read as follows: 17 a. Each city that had an urban renewal plan and area in 18 effect at any time during the most recently ended fiscal year 19 shall complete for each such urban renewal plan and area and 20 file with the department of management an urban renewal report 21 by December 1 following the end of such fiscal year. Each 22 report shall be approved by the affirmative vote of a majority 23 of the city council and be prepared in the format and submitted 24 electronically pursuant to the instructions prescribed by the 25 department of management in consultation with the legislative 26 services agency . 27 c. By December 1, 2012, the department of management , in 28 collaboration with the legislative services agency, shall make 29 publicly available on an internet site a searchable database 30 of all such information contained in the reports required 31 under this subsection . Reports from previous years shall be 32 retained by the department and shall continue to be available 33 and searchable on the internet site. 34 Sec. 47. Section 404A.5, subsection 1, Code 2022, is amended 35 -17- LSB 6033YH (5) 89 ss/rn 17/ 21

The authority, in consultation with the department of 2 revenue, shall be responsible for keeping the general assembly 3 and the legislative services agency informed on the overall 4 economic impact to the state of qualified rehabilitation 5 projects. 6 Sec. 48. Section 421.17, subsection 23, Code 2022, is 7 amended to read as follows: 8 23. To develop, modify, or contract with vendors to create 9 or administer systems or programs which identify nonfilers of 10 returns or nonpayers of taxes administered by the department 11 and to identify and prevent the issuance of fraudulent or 12 erroneous refunds. Fees for services, reimbursements, 13 costs incurred by the department, or other remuneration 14 may be funded from the amount of tax, penalty, or interest 15 actually collected and shall be paid only after the amount 16 is collected. An amount is appropriated from the amount 17 of tax, penalty, and interest actually collected, not to 18 exceed the amount collected, which is sufficient to pay for 19 services, reimbursement, costs incurred by the department, 20 or other remuneration pursuant to this subsection . Vendors 21 entering into a contract with the department pursuant to this 22 subsection are subject to the requirements and penalties of the 23 confidentiality laws of this state regarding tax information. 24 The director shall report annually to the legislative services 25 agency and the chairpersons and ranking members of the ways 26 and means committees on the amount of costs incurred and paid 27 during the previous fiscal year pursuant to this subsection 28 and the incidence of refund fraud and the costs incurred and 29 amounts prevented from issuance during the previous fiscal year 30 pursuant to this subsection . 31 Sec. 49. Section 421.17, subsection 27, paragraphs h and j, 32 Code 2022, are amended to read as follows: 33 h. The director shall report quarterly to the legislative 34 fiscal committee , the legislative services agency, and the 35 -18- LSB 6033YH (5) 89 ss/rn 18/ 21
H.F. 2319 chairpersons and ranking members of the joint appropriations 1 subcommittee on administration and regulation concerning the 2 implementation of the centralized debt collection program, 3 the number of departmental collection programs initiated, the 4 amount of debts collected, and an estimate of future costs and 5 benefits which may be associated with the collection program. 6 It is the intent of the general assembly that the centralized 7 debt collection program will result in the collection of at 8 least two dollars of indebtedness for every dollar expended in 9 administering the collection program during a fiscal year. 10 j. Of the amount of debt actually collected pursuant to 11 this subsection an amount, not to exceed the amount collected, 12 which is sufficient to pay for salaries, support, maintenance, 13 services, and other costs incurred by the department related to 14 the administration of this subsection shall be retained by the 15 department. Revenues retained by the department pursuant to 16 this section shall be considered repayment receipts as defined 17 in section 8.2 . The director shall, in the annual budget 18 request pursuant to section 8.23 , make an estimate as to the 19 amount of receipts to be retained and the estimated amount of 20 additional receipts to be collected. The director shall report 21 annually to the department of management , and the legislative 22 fiscal committee , and the legislative services agency on any 23 additional positions added and the costs incurred during the 24 previous fiscal year pursuant to this subsection . 25 Sec. 50. Section 456A.33B, subsection 2, paragraph a, Code 26 2022, is amended to read as follows: 27 a. It is the intent of the general assembly that the 28 department of natural resources shall develop annually a 29 lake restoration plan and report that shall be submitted to 30 the joint appropriations subcommittee on transportation, 31 infrastructure, and capitals and the legislative services 32 agency by no later than January 1 of each year. The plan and 33 report shall include the department’s plans and recommendations 34 for lake restoration projects to receive funding consistent 35 -19- LSB 6033YH (5) 89 ss/rn 19/ 21
H.F. 2319 with the process and criteria provided in this section , and 1 shall include the department’s assessment of the progress and 2 results of projects funded with moneys appropriated under this 3 section . 4 Sec. 51. Section 602.8107, subsection 6, Code 2022, is 5 amended to read as follows: 6 6. Reports. The judicial branch shall prepare a report 7 aging the court debt. In addition, the report shall include 8 the amounts written off pursuant to subsection 5 . The judicial 9 branch shall provide the report to the co-chairpersons and 10 ranking members of the joint appropriations subcommittee on 11 the justice system , the legislative services agency, and the 12 department of management by December 15 of each year. 13 Sec. 52. REPEAL. Sections 2A.1, 2A.2, 2A.3, and 2A.4, Code 14 2022, are repealed. 15 Sec. 53. EFFECTIVE DATE. This division of this Act takes 16 effect July 1, 2023. 17 DIVISION II 18 LEGISLATIVE SERVICES AGENCY ELIMINATION STUDY COMMITTEE 19 Sec. 54.
