H.F. 2201 Section 1. NEW SECTION . 279.50B Sexual orientation or 1 gender identity instruction. 2 1. As used in this section, unless the context otherwise 3 requires: 4 a. “Gender identity” means the same as defined in section 5 216.2. 6 b. “Sexual orientation” means the same as defined in section 7 216.2. 8 2. Each school district that provides any program, 9 curriculum, material, test, survey, questionnaire, activity, 10 announcement, promotion, or instruction of any kind relating 11 to sexual orientation or gender identity, whether offered as 12 part of human growth and development instruction or any other 13 area of instruction, shall annually provide to a parent or 14 guardian of a pupil enrolled in the school district all of the 15 following: 16 a. Information about the sexual orientation or gender 17 identity program, curriculum, material, test, survey, 18 questionnaire, activity, or instruction used in the pupil’s 19 grade level. 20 b. The procedure for inspecting any such related materials 21 prior to use of such materials in the pupil’s classroom. 22 c. Information regarding the procedure the parent or 23 guardian must follow to request that the pupil be excused from 24 such instruction and from receiving any related materials. 25 3. Each school district shall, upon request by any agency 26 or organization, provide information about any program, 27 curriculum, material, test, survey, questionnaire, activity 28 or instruction of any kind related to sexual orientation or 29 gender identity used in each grade level and the procedure for 30 inspecting and updating the same. 31 4. A pupil shall not be required to take or participate in 32 any program, curriculum, material, test, survey, questionnaire, 33 activity, or instruction of any kind, whether offered as part 34 of human growth and development instruction or any other 35 -1- LSB 5349YH (5) 88 kh/jh 1/ 3
H.F. 2201 area of instruction, related to sexual orientation or gender 1 identity if the pupil’s parent or guardian exercises the 2 parent’s or guardian’s right to file with the appropriate 3 principal a written request that the pupil be excused. 4 Notification that the written request may be made shall be 5 included in information provided by the school district. 6 5. This section shall not be construed to require a school 7 district to provide any activity, curriculum, materials, tests, 8 survey, questionnaire, or instruction of any kind relating to 9 sexual orientation or gender identity that is not otherwise 10 required by law. 11 EXPLANATION 12 The inclusion of this explanation does not constitute agreement with 13 the explanation’s substance by the members of the general assembly. 14 This bill requires school districts to provide notification 15 and information relating to, and allows pupils to be excused 16 from, any program, curriculum, material, test, survey, 17 questionnaire, activity, announcement, promotion, or 18 instruction of any kind relating to sexual orientation or 19 gender identity. 20 The bill requires a school district that provides such 21 instruction or related material to annually provide to a 22 parent or guardian of a pupil enrolled in the school district 23 with information about the instruction or material used in 24 the pupil’s grade level, the procedure for inspecting the 25 materials prior to their use in the classroom, and information 26 regarding the procedure the parent or guardian must follow to 27 request that the pupil be excused from the instruction and from 28 receiving any related materials. 29 The school district must, upon request by any agency or 30 organization, provide information about such instruction and 31 related materials and the procedure for inspecting and updating 32 the same. 33 A pupil shall not be required to take or participate in any 34 such instruction or receive related materials if the pupil’s 35 -2- LSB 5349YH (5) 88 kh/jh 2/ 3
