Section 256.9, subsection 46, paragraph a, Code 1 2 2017, is amended to read as follows: 1 3 a. Develop and make available to school districts, 1 4 examples of age=appropriate, developmentally appropriate, and 1 5 research=based materials and lists of resources which parents 1 6 may use to teach their children to recognize unwanted physical 1 7 and verbal sexual advances, to not make unwanted physical and 1 8 verbal sexual advances, to effectively reject unwanted sexual 1 9 advances, that it is wrong to take advantage of or exploit 1 10 another person, about the dangers of sexual exploitation by 1 11 means of the internet including specific strategies to help 1 12 students protect themselves and their personally identifiable 1 13 information from such exploitation, and about counseling, 1 14 medical, and legal resources available to survivors of sexual 1 15 abuse and sexual assault, including resources for escaping 1 16 violent relationships. The materials and resources shall cover 1 17 child sexual abuse and sexual assault awareness and prevention, 1 18 verbal, physical, and visual sexual harassment, including 1 19 nonconsensual sexual advances, and nonconsensual physical 1 20 sexual contact. In developing the materials and resource list, 1 21 the director shall consult with entities that shall include 1 22 but not be limited to the departments of human services, 1 23 public health, and public safety, education stakeholders, 1 24 and parent=teacher organizations. School districts shall 1 25 provide age=appropriate, developmentally appropriate, and 1 26 research=based materials and a list of available community and 1 27 internet=based resources to parents at registration and shall 1 28 also include the age=appropriate, developmentally appropriate, 1 29 and research=based materials and resource list in the student 1 30 handbook. School districts are encouraged to work with their 1 31 communities to provide voluntary parent education sessions to 1 32 provide parents with the skills and appropriate strategies 1 33 to teach their children as described in this subsection. 1 34 School districts shall incorporate the age=appropriate, 1 35 developmentally appropriate, and research=based materials 2 1 into relevant curricula and shall reinforce with parents and 2 2 students the importance of preventive measures when reasonable 2 3with parents and students. 2 4 Sec. 2. Section 256.9, subsection 46, Code 2017, is amended 2 5 by adding the following new paragraph: 2 6 NEW PARAGRAPH. c. Seek and use funds available to the 2 7 department under the federal Elementary and Secondary Education 2 8 Act of 1965, 20 U.S.C. {6301 et seq., as amended by the federal 2 9 Every Student Succeeds Act, Pub. L. No. 114=95, Tit. II, 2 10 {{2001=2104, and Tit. IV, {{4001=4101, to provide to school 2 11 districts with approved applications for allocations from 2 12 such funds training for school district personnel, including 2 13 teachers, principals, other school leaders, specialized 2 14 instructional support personnel, and para=educators, regarding 2 15 how to prevent and recognize child sexual abuse and regarding 2 16 child sexual abuse awareness and prevention programs or 2 17 activities, such as programs or activities designed to provide 2 18 age=appropriate and developmentally appropriate instruction 2 19 for students in child sexual abuse awareness and prevention, 2 20 including how to recognize child sexual abuse and how to safely 2 21 report child sexual abuse, and to provide information for 2 22 parents and guardians of students about child sexual abuse 2 23 awareness and prevention, including how to recognize child 2 24 sexual abuse and how to discuss child sexual abuse with a 2 25 child. 2 26 Sec. 3. Section 272.2, Code 2017, is amended by adding the 2 27 following new subsection: 2 28 NEW SUBSECTION. 20. Adopt rules establishing that 2 29 continuing education requirements for issuance, renewal, or 2 30 upgrade of a license may include participating in or presenting 2 31 at in=service training programs on child sexual abuse and 2 32 sexual assault awareness and prevention. 2 33 Sec. 4. Section 279.50, Code 2017, is amended by adding the 2 34 following new subsection: 2 35 NEW SUBSECTION. 2A. The human growth and development 3 1 curriculum shall include age=appropriate, developmentally 3 2 appropriate, and research=based instruction for students in 3 3 child sexual abuse and sexual assault awareness and prevention, 3 4 including how to recognize child sexual abuse and sexual 3 5 assault and how to safely report child sexual abuse and sexual 3 6 assault. 3 7 Sec. 5. STATE MANDATE FUNDING SPECIFIED. In accordance 3 8 with section 25B.2, subsection 3, the state cost of requiring 3 9 compliance with any state mandate included in this Act shall 3 10 be paid by a school district from state school foundation aid 3 11 received by the school district under section 257.16. This 3 12 specification of the payment of the state cost shall be deemed 3 13 to meet all of the state funding=related requirements of 3 14 section 25B.2, subsection 3, and no additional state funding 3 15 shall be necessary for the full implementation of this Act 3 16 by and enforcement of this Act against all affected school 3 17 districts. 3 18 EXPLANATION 3 19 The inclusion of this explanation does not constitute agreement with 3 20 the explanation's substance by the members of the general assembly. 3 21 This bill relates to child sexual abuse and sexual assault 3 22 awareness and prevention by directing the board of educational 3 23 examiners to adopt rules establishing that continuing education 3 24 requirements for issuing, renewing, or upgrading of a license 3 25 may include but are not limited to participating in or 3 26 presenting at in=service training programs on child sexual 3 27 abuse and sexual assault awareness and prevention. The bill 3 28 also requires school districts to provide instruction in child 3 29 sexual abuse and sexual assault awareness and prevention 3 30 as part of its human growth and development curriculum in 3 31 kindergarten through grade 12. 3 32 Currently, the director of the department of education has a 3 33 duty to develop and make available to school districts examples 3 34 of age=appropriate and research=based materials. The bill 3 35 specifies that the materials and resources shall also cover 4 1 child sexual abuse and sexual assault awareness and prevention. 4 2 The director is also directed to seek and use funds available 4 3 to the department under the federal Elementary and Secondary 4 4 Education Act of 1965, as amended by the federal Every 4 5 Student Succeeds Act, Pub. L. No. 114=95, to provide to school 4 6 districts with approved applications for allocations from such 4 7 funds training for school district personnel regarding child 4 8 sexual abuse and sexual assault awareness. 4 9 The bill may include a state mandate as defined in Code 4 10 section 25B.3. The bill requires that the state cost of 4 11 any state mandate included in the bill be paid by a school 4 12 district from state school foundation aid received by the 4 13 school district under Code section 257.16. The specification 4 14 is deemed to constitute state compliance with any state mandate 4 15 funding=related requirements of Code section 25B.2. The 4 16 inclusion of this specification is intended to reinstate the 4 17 requirement of political subdivisions to comply with any state 4 18 mandates included in the bill. LSB 1824YH (4) 87 kh/sc
