Honorable Calvin K.Y. Say

Speaker, House of Representatives

Twenty-Sixth State Legislature

Regular Session of 2012

State of Hawaii

Sir:

Your Committee on Hawaiian Affairs, to which was referred S.C.R. No. 155, S.D. 2, entitled:

"SENATE CONCURRENT RESOLUTION URGING THE KAHO‘OLAWE ISLAND RESERVE COMMISSION TO REQUIRE EACH STEWARDSHIP PROGRAM CONDUCTING ACTIVITIES ON THE KAHOOLAWE ISLAND RESERVE TO OBTAIN LIABILITY AND PROPERTY DAMAGE INSURANCE AND LIST THE STATE AS AN ADDITIONAL INSURED,"

begs leave to report as follows:

The purpose of this measure is to urge the Kahoolawe Island Reserve Commission to require each stewardship program conducting activities on the Kahoolawe Island Reserve to obtain liability and property damage insurance and list the State as an additional insured.

The Maui County representative of the Kahoolawe Island Reserve Commission and a concerned individual supported the measure.  Kohe Mālamalama O Kanaloa/Protect Kahoolawe Fund supported the measure with amendments.

Your Committee respectfully notes that as this measure moves through the legislative process to the Committee on Finance that the committee be aware of a proposed amendment to this measure to provide the correct date of an accident involving a Protect Kahoolawe Ohana access participant and clarify that the boat was not contracted, but was rather provided by a volunteer of the Protect Kahoolawe Ohana and that this boat was registered with the Kahoolawe Island Reserve Commission.

As affirmed by the record of votes of the members of your Committee on Hawaiian Affairs that is attached to this report, your Committee concurs with the intent and purpose of S.C.R. No. 155, S.D. 2, and recommends that it be referred to the Committee on Finance.

Respectfully submitted on behalf of the members of the Committee on Hawaiian Affairs,
