A BILL FOR AN ACT

 

 

relating to county gambling ordinances.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to allow county ordinances to control, prohibit, deter, or otherwise affect gambling so long as no ordinance conflicts with state gambling law.

     SECTION 2.  Chapter 712, Hawaii Revised Statutes, is amended by adding a new section to part III to be appropriately designated and to read as follows:

     "§712-     County ordinances; gambling.  Nothing in this part shall be construed to supersede or in any manner affect any county ordinance that controls, prohibits, deters, or otherwise affects gambling; provided that the county ordinance shall not conflict with this part."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
