A BILL FOR AN ACT
RELATING TO LIBRARIES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
"§312-
Library materials;
review; duplicative or substantially similar requests. In
any policy or procedure established by the board of education or Hawaii state
public library system to allow persons to request review of items within the system's
collection to determine if those items are consistent with the system's
collection development policy, the state librarian may decline to conduct a
review if:
(1) A person requests review of an item
that was previously reviewed by the system in good faith;
(2) The basis for the current request is
duplicative or substantially similar to the basis of the prior review;
(3) The response to the prior review was
issued within one calendar year of the date on which current request was
received; and
(4) The state librarian determines, in the state librarian's sole discretion, that the library's response to the current request is unlikely to differ from the response issued for the prior request."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
