A BILL FOR AN ACT

 

 

Relating to the auditor.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  In the regular session of 2015, the twenty-eighth legislature is considering S.B. No.     that mandates a benefit of three in vitro fertilization cycles or a live birth for all outpatient expenses arising from in vitro fertilization procedures performed on an insured or an insured's dependent.

     Section 23-51, Hawaii Revised Statutes, requires that "[b]efore any legislative measure that mandates health insurance coverage for specific health services, specific diseases, or certain providers of health care services as part of individual or group health insurance policies, can be considered, there shall be a concurrent resolution passed requesting the auditor to prepare and submit to the legislature a report that assesses both the social and financial effects of the proposed mandated coverage."  Further, section 23-52, Hawaii Revised Statutes, sets forth the minimum information required to be considered in assessing the social and financial impact of the proposed health coverage and included in the auditor's report.

     The twenty-eighth legislature is also considering S.C.R.     in the 2015 regular session.  The purpose of this concurrent resolution is to satisfy the requirements of sections 23-51 and 23-52 as a pre-condition to mandating insurance coverage for infertility procedures as set forth in S.B. No.    .

     The purpose of this Act is to appropriate funds to the auditor to carry out the study assessing the social and financial effects of requiring health insurers to provide infertility procedure coverage.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2015-2016 for the auditor to assess the social and financial effects of requiring health insurers to provide infertility procedure coverage.

     The sum appropriated shall be expended by the auditor for the purposes of this Act.

     SECTION 3.  This Act shall take effect on July 1, 2015.
