A BILL FOR AN ACT

 

 

relating to the department of land and natural resources.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that Act 55 of 2011 established the public lands development corporation and granted powers to exempt development projects from laws that require review of substantial environment, ecological, and cumulative impacts of development in the affected area.  The legislature finds that the burdens placed upon the residents of this State due to the operation of the public lands development corporation are unnecessary and overly burdensome.  In 2012, the legislature passed Act 282 of 2012, which granted additional powers to the public lands development corporation and transferred development rights of certain lands under the division of boating and ocean recreation and land division to the public land development corporation.  The legislature finds that the increased operations of the public lands development corporation are onerous to the residents of the State and, while well intended, are contrary to the public good in their implementation.  For these reasons, the purpose of this Act is to repeal Act 282 of 2012.

     SECTION 2.  Act 282 of 2012 is repealed.

     SECTION 3.  This Act shall take effect upon its approval.
