A BILL FOR AN ACT

 

 

relating to medicaid.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 346, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§346-      Dependent child; medicaid developmental disability services; alien eligibility.  (a)  The dependent child of any active duty military service member who is a resident of the State, and who has previously received medicaid developmental disability services in another state, shall be eligible for the same medicaid developmental disability services in the State as long the child remains otherwise eligible.

     (b)  Any dependent child who previously received medicaid developmental disability services while a resident of the State, and who left the State due to the military assignment of a parent or guardian who is an active duty military service member, shall be entitled to medicaid developmental disability services upon return to the State and proper request for services demonstrating continued eligibility.

     (c)  If the department of human services has a waiting list for medicaid developmental disability services, any active duty military service member, who is a parent or guardian of a dependent child who does not reside in the State, shall be authorized to place that dependent child on the department of human services' waiting list for medicaid developmental disability services if the dependent child left the State because the parent or guardian was assigned to military service out of the State; provided that any dependent child's place on the waiting list shall be forfeited if the dependent child does not become a resident of the State within three months of the parent or guardian's separation or retirement from military service.

     (d)  For purposes of this section, "medicaid developmental disability services" shall include waiver services provided by the home and community-based services programs authorized under section 1915(c) of the Social Security Act (42 U.S.C. section 1396n(c)) or under any other applicable section or sections of the Social Security Act for the purposes of providing home and community-based services."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
