A BILL FOR AN ACT

 

 

RELATING TO CORRECTIONS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The director of public safety shall submit a report to the legislature, not later than twenty days prior to the convening of the regular session of 2018, which addresses solitary confinement in Hawaii and Arizona correctional facilities that house Hawaii inmates, and includes:

     (1)  The number of inmates housed in solitary confinement;

     (2)  In cases where an inmate's length of stay in administrative segregation is fourteen days or more or length of stay in disciplinary segregation is sixty days or more, the director of public safety shall explain the reasons for an inmate's segregation;

     (3)  The number of transgender inmates housed in solitary confinement, the reasons for their segregation, and the length of stay of their solitary confinement; and

     (4)  Any other information that the director of public safety may deem relevant for this report.

     SECTION 2.  (a)  The department of public safety shall expand the current environmental impact statement process for potential sites for the Oahu community correctional center relocation by:

     (1)  Considering alternative sites of 4.5 acres in size or larger and providing a list of alternative sites and the reasons for adding or omitting the alternative sites from consideration as potential sites for the Oahu community correctional center relocation; and

(2)  Consulting with the task force created by house concurrent resolution no. 85 (2016) and the corrections population management commission about the appropriate capacity and design of the relocated Oahu community correctional center in view of changes to the criminal justice system in areas of pre-trial diversion programs, expansion of Hawaii's Opportunity Probation with Enforcement (HOPE) program and other probation programs, expansion of work furlough, and the use of other alternatives to incarceration programs.

     (b)  The director of public safety shall submit a report with respect to paragraphs (1) and (2) to the legislature no later than twenty days prior to the convening of the regular session of 2018.

     SECTION 3.  This Act shall take effect on July 1, 2050.
