A BILL FOR AN ACT

 

 

RELATING TO internet crimes against children.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 846F-3, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  The court shall order every defendant to pay an internet crimes against children fee of [up to $100 for each felony or misdemeanor conviction;]:

     (1)  Not less than $25 for a misdemeanor offense;

     (2)  Not less than $50 for a class C felony offense;

     (3)  Not less than $75 for a class B felony offense;

     (4)  Not less than $100 for a class A felony offense;

provided that there shall be an additional $150 fee for any offense related to a sex offense; provided further that no fee shall be ordered when the court determines that the defendant is unable to pay the fee."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  This Act shall take effect on July 1, 2015.
