A BILL FOR AN ACT

 

 

RELATING to EXTRACURRICULAR activities.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§302A‑    Participation in extracurricular activities by home schooled children.  (a)  As used in this section, "extracurricular activity" means a school-authorized or education-related activity occurring during or outside the regular instructional school day, including, but not limited to, sports, cheerleading, music, band, clubs, and other programs.

     (b)  A child who is home schooled in accordance with section 302A-1132 shall be eligible to participate in extracurricular activities at the public school that the child would otherwise be required to attend.  A home schooled child who wishes to participate in an extracurricular activity shall meet the participation requirements and restrictions for that activity, including, but not limited to, maintaining appropriate grade point averages and paying appropriate fees; provided that the requirements or restrictions shall not be inconsistent with this section.

     (c)  The department shall adopt rules to effectuate this section and to provide procedures by which a home schooled child may apply to participate in extracurricular activities.  The department may also adopt rules setting forth which programs qualify as extracurricular activities under this section."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
