A BILL FOR AN ACT

 

 

RELATING TO HEALTH.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that there are medicaid beneficiaries in the State with intellectual or developmental disabilities who are unable to access home- and community-based services.  These individuals are at higher risk for future institutionalization because they may lack independent daily living skills and may be unable to manage their own care or to access the support necessary to maintain their independence.

     The legislature further finds that establishing and implementing a program for providing home- and community-based services to at-risk individuals having intellectual or developmental disabilities requires a thorough analysis to ensure an appropriate continuum of care to these individuals.

     Accordingly, the purpose of this Act is to convene a working group to study the design and implementation of a program for providing home- and community-based services to individuals with intellectual or developmental disabilities who are found, through assessment, to be at risk of institutionalization.

     SECTION 2.  The state council on developmental disabilities shall convene a working group to study the design and implementation of a program for providing home- and community-based services to individuals with intellectual or developmental disabilities who are found, through assessment, to be at risk of institutionalization.

     The study shall include recommendations for:

     (1)  Defining the eligibility criteria for the population to be served under the program;

     (2)  Projecting the potential number of eligible individuals who will participate in the program;

     (3)  Identifying the clinical criteria and instruments to be used to establish the population to be served under the program;

     (4)  Delineating the service array and definitions, and any service limitations, of the program;

     (5)  Establishing provider qualifications for the program;

     (6)  Implementing and administering the program; and

     (7)  Providing a cost study as needed to estimate costs associated with the design and implementation of the program.

     SECTION 3.  The state council on developmental disabilities shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2021.

     SECTION 4.  This Act shall take effect on December 31, 2059.
