A BILL FOR AN ACT

 

 

relating to charter schools.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that all charter schools in Hawaii are charted by the state public charter school commission under the oversight of the board of education and subject to the operating parameters of the department of education.  The legislature further finds that there are thirty-seven charter schools serving approximately twelve thousand students, of whom approximately seventy per cent would qualify for federal food subsidies.

     The legislature also finds that some charter schools, especially those in rural areas of Hawaii, are denied access to national school lunch program subsidies because there are no United States Department of Agriculture certified kitchens available, other than those in public schools.  The legislature further finds that the department of education decided to deny access by charter school students to public school food services.  The legislature further finds that this decision caused a loss of federal school lunch subsidies for the qualifying students. 

     The purpose of this Act is to require the department of education to provide equal access to food service facilities for charter school students and to provide funds to provide school breakfasts and lunches to charter school students. 

     SECTION 2.  Section 302A-404, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  School meals shall be made available under the school meals program in every school where the students are required to eat meals at school.  School meals shall be made available to students who attend a charter school."

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2018-2019 for the department of education to provide school meals to students at charter schools, including but not limited to hiring additional staff, purchasing food, and applying for subsidies from the federal government.

     The sum appropriated shall be expended by the department of education for the purposes of this Act.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval; provided that section 3 shall take effect on July 1, 2018.
