A BILL FOR AN ACT

 

 

RELATING TO PUBLIC LANDS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The department of land and natural resources shall transfer the parcels of land identified by tax map key numbers (9)4-0-12:001, (9)4-0-12:002, and (9)4-0-12:003 to the agribusiness development corporation no later than January 1, 2013.  The department of land and natural resources shall be responsible for properly documenting the changes in title.

     SECTION 2.  All rights, powers, functions, and duties of the department of land and natural resources relating to the lands transferred to the agribusiness development corporation shall be transferred with the lands to which they relate.

     Every reference to the department of land and natural resources or board of land and natural resources in all deeds, leases, contracts, loans, agreements, permits, or other documents executed or entered into by or on behalf of the department with respect to the lands transferred shall be construed as a reference to the agribusiness development corporation or the board of directors of the agribusiness development corporation, as appropriate.

     SECTION 3.  This Act shall take effect on July 1, 2012.
