A BILL FOR AN ACT

 

 

RELATING TO MEDICAL ASSISTANCE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that in order to provide important health care for the homeless, the State needs pertinent data regarding the treatments and services administered to the homeless.  Information on the usage of health care can assist the governor, the legislature, and the public to make informed policy decisions about the allocation of resources and services necessary to assist the homeless.

     The purpose of this Act is to promote the health of Hawaii's homeless population by establishing a system to securely gather data regarding homeless individuals' usage of publicly funded medical assistance programs.

     SECTION 2.  Chapter 346, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§346-     Homeless medical assistance recipients; usage; reporting.  (a)  Each provider of health care under the state medicaid program may place on the medicaid certification and recertification forms a question composed by the department of humans services to determine the housing status of the individual.

     (b)  Each provider of health care under the state medicaid program may collect and release to the legislature aggregate housing status information; provided that the release of information shall not include the name of any individual and shall be subject to applicable privacy standards established under federal medicaid regulations and the administrative simplification provisions of the Health Insurance Portability and Accountability Act of 1996, Public Law 104-191."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on January 1, 2017.
