A BILL FOR AN ACT
relating to proposing amendments to the united states constitution.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that the federal government has overreached its constitutionally established boundaries, which has resulted in the federal government adopting administrative rules on subjects over which the executive branch lacks proper authority. The federal executive branch is violating the checks and balances principle of establishing three separate but equal branches of government. A federal constitutional amendment is necessary to clarify the powers of the executive branch.
Article V of the Constitution of the United States authorizes the United States Congress to call for a constitutional convention for proposing amendments on the "Application of the legislatures of two thirds of the several states". The constitutional convention is referred to in modern times as a convention of states. Proposed amendments to the Constitution of the United States made by a constitutional convention require the ratification by the legislatures of three fourths of the states.
The purpose of this Act is to authorize the United States congress to call a convention for proposing amendments to the Constitution of the United States.
SECTION 2. Pursuant to Article V of the Constitution of the United States, the Congress of the United States is requested to call a constitutional convention for proposing amendments to the Constitution of the United States.
This section shall be deemed an application by the legislature of the State of Hawaii for purposes of Article V of the Constitution of the United States.
SECTION 3. This Act shall take effect upon its approval.
