A BILL FOR AN ACT
RELATING TO ANATOMICAL TRANSPLANTS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 431, Hawaii Revised Statutes, is amended by adding a new section to article 10A to be appropriately designated and to read as follows:
"§431:10A- Organ or tissue transplantation coverage. No insurer that issues a policy, contract, plan, or agreement in this State that provides coverage for the costs of solid organ or other tissue transplantation services shall deny or limit such coverage on the basis that the individual to be insured is infected with the human immunodeficiency virus."
SECTION 2. Chapter 432, Hawaii Revised Statutes, is amended by adding a new section to article 1 to be appropriately designated and to read as follows:
"§432:1- Organ or tissue transplantation coverage. No mutual benefit society that issues a policy, contract, plan, or agreement in this State that provides coverage for the costs of solid organ or other tissue transplantation services shall deny or limit such coverage on the basis that the member is infected with the human immunodeficiency virus."
SECTION 3. Chapter 432, Hawaii Revised Statutes, is amended by adding a new section to article 2 to be appropriately designated and to read as follows:
"§432:2- Organ or tissue transplantation coverage. No fraternal benefit society that issues a policy, contract, plan, or agreement in this State that provides coverage for the costs of solid organ or other tissue transplantation services shall deny or limit such coverage on the basis that the member is infected with the human immunodeficiency virus."
SECTION 4. Chapter 432D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§432D- Organ or tissue transplantation coverage. No health maintenance organization that issues a policy, contract, plan, or agreement in this State that provides coverage for the costs of solid organ or other tissue transplantation services shall deny or limit such coverage on the basis that the enrollee or subscriber is infected with the human immunodeficiency virus."
SECTION 5. New statutory material is underscored.
SECTION 6. This Act shall take effect on July 1, 2050.
