A BILL FOR AN ACT

 

 

relating to electronically-stored identification.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the use of electronically-stored driver's licenses and identification cards is expanding.  The states of Arizona, Connecticut, Georgia, Iowa, Kentucky, Maryland, Oklahoma, and Utah all either support the use of electronically-stored identification or are in the process of enacting legislation to support that use.  Additionally, users of electronically-stored identification in those states will be able to present electronically-stored identification at Transportation Security Administration checkpoints in participating airports.  The legislature further finds that electronically-stored identification provides a secure and safe alternative to carrying and presenting a physical driver's license or identification card.

     The purpose of this Act is to authorize electronically-stored driver's licenses and identification cards to be stored and presented through an approved electronic identification storage service.

     SECTION 2.  Chapter 286, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§286-    Electronically-stored identification.  (a)  An electronically-stored driver's license or identification card shall be accepted in any situation in which presentation of a driver's license or identification card is required.

     (b)  The director shall designate the electronic identification storage services that may be used pursuant to subsection (a).  The director may procure and designate commercially available electronic identification storage services or electronic identification storage services provided by the State; provided that no electronic identification storage services shall be procured or designated by the director without a determination that the electronic identification storage services meets minimum standards of security, safety, and privacy as determined by the director.

     (c)  The department shall adopt rules in accordance with chapter 91 to implement this section.

     (d)  For the purposes of this section:

     "Electronic identification storage services" means a software application capable of securely storing and displaying an electronic image of an existing driver's license or identification card.

     "Electronically-stored driver's license or identification card" means an electronic image of an existing driver's license or identification card, as those terms are defined in section 286-2, stored in an electronic identification storage service."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
