A BILL FOR AN ACT

 

 

Relating to motor vehicle safety.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 291C, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§291C-    Vehicle approaching a parked, stopped, or standing authorized emergency vehicle.  The driver of a vehicle shall exercise due care when approaching an authorized emergency vehicle that is parked, stopped, or standing on the shoulder or any portion of a highway and is making use of authorized visual signals, such as one or more red, blue, or white lights, or any combination thereof.  For drivers of vehicles on controlled access roadways or highways, due care shall include but not be limited to reducing speed and moving from a lane that contains or is immediately adjacent to the shoulder where an authorized emergency vehicle that is making use of authorized visual signals is parked, stopped, or standing, to another lane; provided that the movement complies with all other requirements of this chapter."


     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
