A BILL FOR AN ACT
Relating to state law enforcement officers.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 28, Hawaii Revised Statutes, is amended by adding a new part to be appropriately designated and to read as follows:
"PART . STATE LAW ENFORCEMENT INVESTIGATION UNIT
§28- State law enforcement investigation unit. (a) There is established within the department of the attorney general a state law enforcement investigation unit.
(b) The unit shall employ such attorneys, auditors, investigators, and other personnel as necessary to promote the effective and efficient conduct of the unit's activities. Except for the attorneys, all other employees of the state law enforcement investigation unit shall be subject to chapter 76.
(c) The state law enforcement investigation unit shall establish formal investigation procedures and conduct administrative, civil, and criminal investigations of state law enforcement officers.
(d) For the purposes of this part, "state law enforcement officer" means any public servant, employed by the State, vested by law with a duty to maintain public order, make arrests for offenses, issue citations, or enforce the criminal laws, whether that duty extends to all offenses or is limited to a specific class of offenses."
SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2012-2013 for the establishment and implementation of the state law enforcement investigation unit.
The sum appropriated shall be expended by the department of the attorney general for the purposes of this Act.
SECTION 3. This Act shall take effect upon its approval.
