A BILL FOR AN ACT

 

 

RELATING TO EXTRACURRICULAR ACTIVITIES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§302A‑    Participation in extracurricular activities by home-schooled children.  (a)  A child who is home schooled in accordance with section 302A-1132 shall be eligible to participate in extracurricular activities at the public school that the child would otherwise be required to attend.  If a home‑schooled child wishes to participate in an extracurricular activity, the following requirements shall be met prior to participation:

     (1)  The child shall meet the participation requirements and restrictions for that activity, including maintaining appropriate grade point averages and paying appropriate fees; provided that the requirements or restrictions shall not be inconsistent with this section; and

     (2)  The parent or guardian of the child shall provide the principal of the public school that the child would otherwise be required to attend with a notification of intent to home school in a manner as determined by the department and by the first day of each school year for which the child intends to home school.

     (b)  The department shall adopt rules to effectuate this section and to provide procedures by which a home-schooled child may apply to participate in extracurricular activities.  The department may also adopt rules setting forth which programs qualify as extracurricular activities under this section.

     (c)  As used in this section, "extracurricular activity" means a school-authorized or education-related activity occurring during or outside the regular instructional school day, including sports, cheerleading, clubs, and other programs."

     SECTION 2.  The department of education shall consult the Athletic Directors and Coaches Association of Hawaii and other agencies and organizations during its rule-making process to effectuate the purposes of this Act and to address specific issues including but not limited to:

     (1)  Appropriate funding for the participation of home-schooled children in extracurricular activities at public schools;

     (2)  Eligibility criteria for home-schooled in extracurricular activities at public schools, such as grade point average requirements;

     (3)  Whether to or how to apply department of education standards, rules, and policies to home-schooled children during or as a prerequisite to their participation in extracurricular activities;

     (4)  Determining and enforcing rules regarding transfers between schools and home schools;

     (5)  Providing adequate protections against the illegal recruitment of students for participation in athletics and other extracurricular activities; and

     (6)  Liability and other legal issues that may arise from the participation of home-schooled children in extracurricular activities at public schools;

provided that any rules adopted relating to the participation of home-schooled children in athletics at public schools shall be consistent with department of education rules relating to the participation of transfer students in athletics at public schools.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2050.

Description:

Allows home-schooled students to participate on an equal basis in extracurricular activities offered at the public school they would otherwise be required to attend if they meet certain requirements.  Requires DOE to consult with the Athletic Directors and Coaches Association of Hawaii during its rule‑making process.  Takes effect 7/1/2050.  (SD1)
