A BILL FOR AN ACT

 

 

RELATING TO TRAFFIC.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 291C, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§291C-    Signage for bicycle proceeding through intersections in right turn only lane.  The director of transportation and the counties in their respective jurisdictions shall identify appropriate intersections and cause signage to be placed within or adjacent to appropriate intersections to allow the driver of a bicycle proceeding in a right turn only lane to continue proceeding through an intersection in the direction of travel if the driver of the bicycle cannot with reasonable safety merge left into the thru traffic lane prior to the intersection, provided that the driver of the bicycle shall not pass a vehicle that is stopped in the right turn only lane; provided further that the driver of the bicycle shall exercise reasonable safety when passing a vehicle proceeding in the same direction in the right turn only lane."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.

Description:

Allows the Director of Transportation and counties to place signage in their jurisdictions to designate appropriate intersections where a bicyclist may proceed through an intersection from a right turn only lane if they cannot safely merge into the thru traffic lane, provided they signal intention to merge left, and proceed in a right turn only lane when approaching an intersection, even if they do not intend to turn right, provided that they do not pass a stopped vehicle and that they exercise reasonable safety when passing a moving vehicle.  (SD1)
