A BILL FOR AN ACT

 

 

RELATING TO HUMAN SERVICES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that for clients of the department of human services who are receiving child welfare services, the transfer of a case worker without notice to the case worker's client places added burdens on children, parents, and caregivers.  This is particularly true when custody issues are involved.

     The purpose of this Act is to require the department of human services to provide a written explanation and notification to the client when the client's case worker has been transferred.

     SECTION 2.  Section 346-51, Hawaii Revised Statutes, is amended to read as follows:

     "§346-51  Public assistance and child welfare services administered by department.  (a)  The department [of human services] shall administer public assistance and child welfare services in the several counties except for payments administered under the Federal Supplemental Security Income Program or its successor agency.  No person shall be denied the right to petition the department for additional assistance as established under section 346-53(f).

     (b)  If a client who is receiving child welfare services under subsection (a) is transferred by the department from one case worker to another case worker, the department shall notify the client in writing of the transfer and include in the notification an explanation of the reason for the change of case worker.  The notice shall be placed in the file of the client."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
