A BILL FOR AN ACT
relating to long-term care facilities.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 346D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§346D- Long-term care facilities; acute medical services;
hospitals; transfer. (a) If an individual residing in a long-term care
facility leaves the facility to seek acute medical services at a hospital, the
long-term care facility shall re-admit and continue providing care for the
individual once the individual's acute medical needs are met and the individual
is released from the hospital.
(b) If an individual receiving care in a hospital
is recommended by the hospital for transfer to a long-term care facility for
continued care and that long-term care facility is licensed in the State, the
individual shall transfer to only that long-term care facility recommended by
the hospital.
(c)
For the purposes of this section:
"Acute medical services" means
inpatient medical care and other related services for surgery or acute medical
conditions or injuries (usually for a short-term illness or condition).
"Hospital" means a facility
licensed under section 321‑14.5, excluding children's hospitals and
specialty hospitals.
"Long-term care
facility" shall have the same meaning as defined in section 349-21(f)."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect on July 1, 2018.

Requires long-term care facilities to continue providing care for individuals after they receive acute medical care from a hospital. Requires a long-term care facility that provides care to an individual who leaves the facility to receive acute medical services at a hospital to readmit and continue providing care for the individual. Requires an individual who is receiving care in a hospital and is recommended by the hospital for transfer to a licensed long-term care facility for continued care to transfer to only that long-term care facility recommended by the hospital.
