A BILL FOR AN ACT

 

 

relating to civil defense.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the State is vulnerable to hazards originating from human and natural causes.  The legislature also finds that a more efficient and effective system is needed to prepare for emergencies and disasters in the State.

     The purpose of this Act is to transfer certain programs and services currently under the jurisdiction of the department of defense to a new department of civil defense.

     SECTION 2.  Effective July 1, 2013, all rights, powers, functions, and duties in the following areas are transferred from the department of defense to the department of civil defense:

     (1)  Civil defense;

     (2)  Hazard mitigation;

     (3)  Disaster preparedness;

     (4)  Disaster relief; and

     (5)  Disaster response and recovery.

     SECTION 3.  All officers and employees whose functions are transferred by this Act shall be transferred with their functions and shall continue to perform their regular duties upon their transfer, subject to the state personnel laws and this Act.

     No officer or employee of the State having tenure shall suffer any loss of salary, seniority, prior service credit, vacation, sick leave, or other employee benefit or privilege as a consequence of this Act, and such officer or employee may be transferred or appointed to a civil service position without the necessity of examination; provided that the officer or employee possesses the minimum qualifications for the position to which transferred or appointed; provided further that subsequent changes in status may be made pursuant to applicable civil service and compensation laws.

     An officer or employee of the State who does not have tenure and who may be transferred or appointed to a civil service position as a consequence of this Act shall become a civil service employee without the loss of salary, seniority, prior service credit, vacation, sick leave, or other employee benefits or privileges and without the necessity of examination; provided that such officer or employee possesses the minimum qualifications for the position to which transferred or appointed.

     If an office or position held by an officer or employee having tenure is abolished, the officer or employee shall not thereby be separated from public employment, but shall remain in the employment of the State with the same pay and classification and shall be transferred to some other office or position for which the officer or employee is eligible under the personnel laws of the State as determined by the head of the department or the governor.

     SECTION 4.  All appropriations, records, equipment, machines, files, supplies, contracts, books, papers, documents, maps, and other personal property heretofore made, used, acquired, or held by the department of defense relating to the functions transferred to the department of civil defense shall be transferred with the functions to which they relate.

     SECTION 5.  (a)  The governor shall select and convene a working group to develop a comprehensive plan for transferring certain rights, powers, functions, duties, and resources to the newly established department of civil defense.

     (b)  The comprehensive plan shall identify:

     (1)  All state programs for civil defense, by division and program identification;

     (2)  Each position to be transferred by position number; and

     (3)  All moneys budgeted in support of each position to be transferred, including moneys for direct and indirect employee benefits, at the lowest level on the state program structure.

     (c)  The working group shall include representatives from the following agencies and departments:

     (1)  The department of defense;

     (2)  The department of the attorney general;

     (3)  The department of accounting and general services;

     (4)  The department of budget and finance;

     (5)  The department of human resources development;

     (6)  The civil defense advisory council; and

     (7)  The county civil defense agencies.

     (d)  The working group shall cease to exist on June 30, 2013.

     SECTION 6.  The legislative reference bureau shall conduct a study to determine conforming amendments to the Hawaii Revised Statutes that may be necessary as a result of the creation of the new department of civil defense to effectuate the purposes of this Act.

     The legislative reference bureau shall submit its findings, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2013.

     SECTION 7.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 8.  This Act shall take effect upon approval.
