A BILL FOR AN ACT

 

 

RELATING to medical cannabis.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that chapter 329, part IX, Hawaii Revised Statutes, was originally enacted in 2000 to establish the medical cannabis program, and chapter 329D, Hawaii Revised Statutes, was originally enacted in 2015 to establish medical cannabis dispensaries.  The legislature further finds that as Hawaii expands its medical cannabis program, it is important that research and development on medical cannabis best practices continues, including the results and outcomes of its use among qualifying patients.  The department of health is not currently collecting data on the usage, dosage, or results of medical cannabis use among qualifying patients.  Such data is invaluable to continued medical research in understanding the benefits of medical cannabis treatment for various illnesses, ailments, diseases, injuries, and other medical issues.  Data collection and research and development conducted by the University of Hawaii John A. Burns school of medicine in conjunction with the department of health on the results of medical cannabis treatment among qualifying patients would be of great value to the State in developing alternative strategies to treating various illnesses and ailments.  The school of medicine is a scholarly body, independent from the dispensaries and the department of health, that could study related health outcomes and serve as an important tool to provide medical insight regarding the medical cannabis program.  Medical cannabis research is yet another area in which Hawaii can lead the way.

     Accordingly, the purpose of this Act is to allow the University of Hawaii John A. Burns school of medicine with support from the department of health to collect data from voluntary qualifying patients, maintain a database, and conduct research and development regarding the efficacy of medical cannabis use in the State and related health outcomes.

     SECTION 2.  Chapter 329D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§329D-    Research and development.  The University of Hawaii John A. Burns school of medicine with support from the department of health may conduct research and development on the efficacy of using medical cannabis for medical treatment among qualifying patients.  The University of Hawaii John A. Burns school of medicine shall offer qualifying patients the opportunity to participate in voluntary data collection for the purposes of medical cannabis research and development.  Data gathered shall include the debilitating medical condition being treated, and the usage, dosage, and results of the medical cannabis treatment.  The University of Hawaii John A. Burns school of medicine shall maintain a secure database based on debilitating medical conditions treated with medical cannabis and shall ensure qualifying patient participants' privacy and compliance with any applicable provisions of the Health Insurance Portability and Accountability Act of 1996.  The research and development under this section shall not include any operational product testing or tests of cannabis chemical composition or similar laboratory-based measurements."

     SECTION 3.  There is appropriated out of the medical cannabis registry and regulation special fund the sum of $100,000 or so much thereof as may be necessary for fiscal year 2018-2019 for the University of Hawaii John A. Burns school of medicine with support from the department of health to collect data from voluntary qualifying patients and maintain a database with privacy safeguards and in compliance with the Health Insurance Portability and Accountability Act of 1996 and to also conduct research and development regarding the efficacy of medical cannabis use in the State and related health outcomes.

     The sum appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2018.
