A BILL FOR AN ACT

 

 

relating to media TRANSPARENCY.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 480B-1, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§480B-1[]]  General definitions.  As used in this chapter:

     "Media" means any [printed publication of general distribution in the State issued once or more per year that is a party to the Mutual Publishing Plan Agreement as executed on May 31, 1962, and any subsequent amendments.] news gathering or reporting agency, including newspapers, radio, television stations or networks, internet-based organizations, news services, magazines, trade papers, in-house publications, professional journals, or other news reporting or news gathering agencies whose function it is to inform the public or some segment thereof."

     SECTION 2.  Section 480B-2, Hawaii Revised Statutes, is amended by amending its title and subsection (a) to read as follows:

     "[[]§480B-2[]]  Disclosure.  (a)  [The] All media shall submit to the attorney general, no later than thirty days after December 31 of the reporting year[, an]:

     (1)  An income tax return filed pursuant to section 235-4[.]; and

     (2)  A financial disclosure statement that lists the media's amounts and sources of income, excluding income from advertisements; provided that the statement shall include donations and names of donors.  Without regard to chapter 92F, the attorney general shall make copies of the financial disclosure statements available on its website."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2023.
